Trump's DOJ Abandons Merrick Garland's Peevish Vendetta Against Whistleblower Doctor

The federal case against Dr. Eithan Haim, the whistleblower who disclosed the illegal pediatric transgender program operated by Texas Children's Hospital, has collapsed. In a tersely worded motion to the court, the Department of Justice announced it was dismissing all charges against Dr. Haim "with prejudice," which means they can't be filed again at a later date.

This story starts in May 2023 when journalist Chris Rufo obtained documents from a whistleblower that proved the pediatric transgender clinic at Texas Children's was continuing to perform medical atrocities on young children despite promising to close the clinic. 

Last spring, executives at Texas Children’s Hospital announced that they would cease performing transgender medical procedures on children, citing potential legal and criminal liability. The hospital’s chief pediatrician, Catherine Gordon, an advocate for “gender-affirming therapy,” abruptly resigned.

I have obtained exclusive whistleblower documents showing that, despite its public statements, the Houston-based children’s hospital—the largest in the United States—has secretly continued to perform transgender medical interventions, including the use of implantable puberty blockers, on minor children. (When reached via email, hospital spokeswoman Kelley Carville responded: “We have no comment.”)

Shortly after the article appeared, Dr. Eithan Haim received a visit from the FBI.

On the morning in June 2023 that Haim was to graduate from Texas Children Hospital’s residency program, federal agents knocked on his door. They had identified him as a potential “leaker,” presumably through forensic examination of the hospital’s computer systems. Shortly thereafter, Assistant U.S. Attorney Tina Ansari began threatening Haim with prosecution.

Now, Ansari has made good on those threats. Earlier this week, U.S. marshals appeared at Haim’s home and summoned him to court to face an indictment on four felony counts of violating HIPAA. His initial appearance is next Monday, where he will learn more about the charges against him.

Shortly after that visit, Haim was arrested and charged with violations of the Health Insurance Portability and Accountability Act, or HIPAA:

A Houston doctor has been indicted for obtaining protected individual health information for patients that were not under his care and without authorization, announced Alamdar S. Hamdani.

The case against Ethan Haim, 34, Dallas, has now been unsealed, and he is set to make his initial appearance before U.S. Magistrate Yvonne Y. Ho in Houston at 2 p.m.

The four-count indictment alleges Haim obtained personal information including patient names, treatment codes and the attending physician from Texas Children’s Hospital’s (TCH) electronic system without authorization. He allegedly obtained this information under false pretenses and with intent to cause malicious harm to TCH.

According to the indictment, Haim was a resident at Baylor College of Medicine and had previous rotations at TCH as part of his residency.

In April 2023, Haim allegedly requested to re-activate his login access at TCH to access pediatric patients not under his care. The indictment alleges he obtained unauthorized access to personal information of pediatric patients under false pretenses and later disclosed it to a media contact.

If convicted, Haim faces up to 10 years in federal prison and a $250,000 maximum possible fine.

FBI conducted the investigation. Assistant U.S Attorney Tina Ansari is prosecuting the case.

Significantly, the indictment misstated, we hope deliberately, HIPAA.

DOJ seems happy, however, to propagate the false, but politically more appealing, notion that Dr. Haim disclosed private patient information. The consolidated Counts Two through Four in the indictment allege that Haim did “obtain and/or wrongfully disclose individually identifiable health information.” But the phrase “and/or wrongfully disclose” is legally meaningless surplusage, as the counts allege only a violation of subsection (a)(2), not subsection (a)(3). And the facts show that Dr. Haim carefully redacted the information in the records that might identify the patients.

DOJ also confusedly contends that “Person1 [evidently Rufo] published HIPAA protected information obtained by Haim” and that although the “HIPAA protected information [published by Rufo] had partially redacted out name of the pediatric patients[, it] kept the dates of service, diagnosis, procedure codes, and physician names visible.” This contention is gibberish.

Ansari, to no one's shock, is a Biden political donor.

Once the case started, it became a textbook example of prosecutorial misconduct and downright creepiness.

The FBI agent in the red shirt is Paul Nixon. This is the famous video of him showing up to the home of @V_Sivadge, the other TCH whistleblower in July 2023.  This is the FBI agent who is also behind the case against me - the one who relied on false testimony to bring the indictment in May 2024.  

He personally came to my first arraignment, sat directly behind me and my pregnant wife, and watched me plead not guilty.  

It's very atypical (and creepy) for an FBI agent to come to arraignments and make a point to sit right behind the person they are setting up for a corrupt prosecution.  

It shows that Paul Nixon took time out of his day to come to something he had no reason to be at. I'm assuming he got some kind of sick pleasure from seeing me enter the criminal justice system alongside murderers and pedophiles. 

It's also important to note that this was happening at the same time that @FBIHouston was ignoring terror threats from people like Shamsud Jabbar who killed all those people in New Orleans on New Year's Eve.  

So while FBI agents were ignoring actual threats from terrorists, FBI agents like Paul Nixon prioritized going to arraignments of the people they were corruptly prosecuting.  

It's sickening to think these people call themselves Americans.

At least Dr. Haim avoided getting a vigorous hair-sniffing by the FBI.

The trial was scheduled to begin on February 10, but President Trump's inauguration changed everything. Haim's wife led a full-bore awareness drive on social media, pointing out how this Department of Justice behavior was exactly what President Trump had forbidden in one of his executive orders.

Missouri Senator Josh Hawley made the right call to the right person.

The next step is for Trump's attorney general to clean house in Houston and remind these people that they are members of the US government, not Stasi functionaries.
