WHAT'S ON TAP?

Today on Capitol Hill...

As the Schumer Shutdown rolls on, the Senate will vote again today on the proposed continuing resolution to fund the government. If it fails (which...seems likely), they'll head home for the weekend and return for another vote on Monday. The House will also be back in session on Monday, as well. 

Meanwhile, the Democrats seem to be confused as to what they're advocating for.

White House What's Up

President Trump, on Friday, will participate in a swearing-in ceremony for Christine Toretti, the U.S. Ambassador to the Kingdom of Sweden.

White House Press Secretary Karoline Leavitt will hold a press briefing at 1:00 PM Eastern. 

Keeping Up With the Cabinet

Sec. Homeland Security - Kristi Noem — Noem noted on X that DHS employees are currently working without pay due to the shutdown, but continuing to work for the American people.

There were several rulings of note on Thursday, including:

  • ✅ State of California v. CMS (regulation aimed at reducing fraud under ACA) — Judge Nathaniel Gorton (Massachusetts), DENIES plaintiffs' motion for preliminary injunction.
  • ❌ City of Columbus v. Kennedy (regulation aimed at reducing fraud under ACA) — Judge Brenda Hurson (Maryland) DENIES admin's motion to stay pending appeal.
  • ❌ National TPS Alliance v. Noem (revocation of TPS -Nepal, Honduras, Nicaragua) — Judge Trina Thompson (Northern District of California) GRANTS plaintiffs' motion for class certification.
  • ❌ American Federation of Government Employees, AFL-CIO v. OPM (termination of probationary employees) — Judge William Alsup STRIKES the admin's post-judgment reply brief in terse order.
  • ✅ State of Oregon v. Trump (National Guard deployment) — Judge Michael Simon (Oregon) has RECUSED himself from the case following the administration's suggestion of recusal.

Sean "Diddy" Combs is set to be sentenced today for his conviction on Mann Act violations.

COMING ATTRACTIONS

Monday is...the first Monday in October, which means SCOTUS Term 2025 is officially upon us. While it will be a bit until the court starts issuing its decisions for the term, oral arguments will get underway, and we'll have previews on those cases each day in our Full Court Press section.

As noted yesterday, the deadline for Hamas to take the peace deal offered is arriving. This could be an eventful weekend — hopefully one that includes the return of the remaining hostages. 

MORNING MUSING

Bear with me, folks — I'm in one of those philosophical moods this AM. It has to do with victim blaming. At first blush, most people recoil at the notion — the "Her skirt was too short" rationalization is gross and disturbing. But it doesn't take much at all for reactions to wander over into, "He had it coming" mentality, now does it?

Think Israelis/Jews following October 7. Think Charlie Kirk following his assassination. Think Mormons following last Sunday's attack in Grand Blanc. 

What...is it about the human condition that prompts some (many?) to justify the brutalization of others in such a manner? Is it a coping mechanism? Only people who do x or think y are in danger? Is it an animal instinct to turn on those who are weakened/injured? 

Whatever it is, it's dark. And I am not a fan.
