Obama-Appointed Activist Judge Talwani Thwarts Trump’s Mail-In Ballot Crackdown

Obama-appointed U.S. District Judge Indira Talwani has blocked key provisions of President Trump’s executive order aimed at cracking down on mail-in ballot fraud.

The brazen judicial resistance, if not outright activism, continues unabated.

Talwani ruled that the Trump administration cannot direct the United States Postal Service (USPS) to withhold delivery of mail-in ballots from states that refuse to turn over their voter rolls for verification.

"The Constitution does not grant the President any specific powers over elections," she declared in her ruling.

Talwani, who was confirmed by the Senate in 2014 by a 94-0 vote, also emphasized that the Constitution reserves voter eligibility determinations to the states alone, and that neither the Executive Branch nor USPS has authority to impose these restrictions on mail ballots.

So ... the President doesn't have authority over elections, but Democrats get to run mail-in voting like a criminal enterprise. Got it. This is less about Talwani defending states’ rights, and more about shielding ballot harvesting and unsecured mail voting.

The question has to be asked — Why?

Talwani's efforts come after Postmaster General David Steiner asserted that the USPS would deliver zero mail-in ballots to any state that continues to hide its voter rolls and refuses to comply with basic verification requirements.

“If a state refuses to turn their absentee voter list over to the federal government, will the Postal Service still mail their ballots under this … rule?” Sen. Gary Peters (D-MI) asked during a congressional hearing just two days ago.

“Under our proposed regulation, no,” Steiner explained.

“I would think that states would want the information to ensure that the ballots that they think they’re sending out are the ballots that are actually getting sent out,” he added.

Talwani, though, doesn't think that's something under the purview of the President or the postal service.

This isn’t Talwani’s first rodeo when it comes to trying to thwart Trump. 

Last year, she blocked the administration from defunding Planned Parenthood through the One Big Beautiful Bill, keeping taxpayer dollars flowing to the abortion giant for weeks until an appeals court, as RedState Deputy Managing Editor Susie Moore wrote at the time, put her "in check."

Talwani also issued a temporary restraining order preventing Trump from revoking parole for hundreds of thousands of migrants from Cuba, Haiti, Nicaragua, and Venezuela (CHNV) as part of his immigration crackdown. 

Now she’s doing it again on election integrity. And while this might not be her first activist rodeo, the Trump administration, which will almost assuredly appeal this latest decision, can rest easy knowing she's 0-for-2 in her attempts to block the President's agenda.

Higher courts overturned her rulings on both Planned Parenthood funding and the CHNV migrant parole program.
