MO Atty Gen Eric Schmitt Announces Court Stay on the Vaccine Mandate Affecting Healthcare Workers

Missouri Attorney General Eric Schmitt has been on the forefront of challenging Biden’s executive orders regarding vaccine mandates in the workplace. On November 10, Schmitt led the charge of filing a lawsuit to halt the Center for Medicare and Medicaid Services’ vaccine mandate on healthcare workers. Ten other states joined him in this suit.

The Missouri Attorney General’s Office has also filed suit to halt the OSHA-ruling mandate requiring vaccination for private employers with over 100 employees, and on federal contractors.

The Mo. AG’s readiness has reaped the benefit. The United States District Court has issued a preliminary injunction halting this vaccine mandate against healthcare workers.

 Today, following a lawsuit from Missouri Attorney General Eric Schmitt, the United States District Court, Eastern District of Missouri, issued a preliminary injunction, halting the Biden Administration from enforcing its vaccine mandate on healthcare workers in the states that joined Missouri’s coalition.

“Earlier today, the United States District Court, Eastern District of Missouri, issued a preliminary injunction halting the Biden Administration from enforcing its vaccine mandate on healthcare workers. This is a huge victory for healthcare workers in Missouri and across the country, including rural hospitals who were facing near certain collapse due to this mandate,” said Attorney General Schmitt. “While today’s ruling is a victory, there’s more work to be done, and I will keep fighting to push back on this unprecedented federal overreach.”

Schmitt is running for Senator to replace Roy Blunt, who has decided not to run again in 2022. So, this small victory will definitely burnish his fighter credentials not just in the State of Missouri, but nationally. Schmitt was one of the AG’s who filed a lawsuit on the “Remain in Mexico” policy, and that win is another feather in his cap.

As Schmitt noted, this is a stay on the enforcement of the mandate, while the 6th Circuit Court of Appeals wades through the lawsuits on the legality of the mandate. What it does mean is that corporate hospitals and medical centers must cease demanding healthcare workers achieve full vaccination by a certain date or lose their employment.

Healthcare workers can breathe a little easier and not worry about their employment status as the legality issues are hashed out.
