False Alarms: Kamala Harris to Urge Nevada Voters to Back Abortion Amendment Rooted in Absurdity

On Monday, Vice President Kamala Harris will visit Las Vegas, campaigning to save her job and to promote Nevada's abortion ballot measure. This measure seeks to enshrine abortion up to 24 weeks gestation in the state constitution.

According to a campaign spokesperson, the Biden-Harris campaign will help collect signatures for the ballot initiative while telling voters to support the effort as "an important step to protect against extremist state lawmakers who may try to adopt another 'Trump abortion ban' in the future.'"

When she does so, Vice President Harris will be lying. Abortion access is already protected in Nevada from all state lawmakers, and it has been for 33 years. And the big lie isn't new. It's a falsehood that Democrats have been exploiting in the Silver State for two election cycles. The legislature is specifically prohibited from making any changes to the state's abortion law without those proposed changes going to the ballot for voters to decide.

Abortion is codified in Nevada Revised Statutes 442.250, a veto referendum known as Question 7, approved by voters in 1990. This is often erroneously called a constitutional amendment, even though I have made that mistake because it acts similarly in tying the legislature’s hands and forcing the issue to the ballot. In other states, referendum petitions seek to repeal, not support statutes, but in Nevada, citizen-initiated referendum results in statute affirmation if successful and repeals legislation if rejected. An affirmed statute prohibits the legislature from repealing or amending voter-approved legislation without putting the proposed changes on the ballot for voter approval.

Kamala Harris to Visit Minnesota Planned Parenthood Clinic - Why?


The ballot initiative is led by Nevadans for Reproductive Freedom political action committee. As of early April, the group reported gathering over 110,000 signatures in support of the abortion ballot question. This surpasses the required threshold of 102,362 signatures needed to qualify for the 2024 ballot. Signatures must also be distributed evenly, with at least 25,591 signatures from each of Nevada's four congressional districts. The deadline for submitting these signatures is set for June 26.

Harris' stop in Nevada comes after her Friday trip to Arizona, where she seized the opportunity to blame the former president for the state's supreme court upholding a law from 1864 that imposes wide restrictions on abortions. Speaking to a crowd in Tucson, Harris blamed the presumptive GOP presidential nominee, Donald Trump, for the abortion policy, saying:

Former President Donald Trump did this. Donald Trump is the architect of this healthcare crisis.

Arizona state Senator Eva Burch will join Harris in Nevada, in what will be the VP's fourth visit to the swing state this year. Her previous trips include campaigning in front of a crowd at Mojave High School, promoting early voting for the 2024 Presidential Preference Primary, and congratulating Culinary Union workers on negotiating contracts with major resort companies. Monday's visit will mark her 12th trip to Nevada since taking office.

Harris is also expected to promote the Bipartisan Safer Communities Act in her remarks, a law signed by President Joe Biden in 2022 that led to a new rule announced by the Justice Department requiring anyone who sells guns to run federal background checks.
