It seems too many of our country's education institutions are requiring reminders that Title IX means what it says, not what they wish it said, and that biological reality is a thing. One such is the historically all-women Smith College, now under investigation by the United States Department of Education under Title IX. Why? They are not only admitting men, but they are also allowing men into women's dorms, bathrooms, showers, and so on. In a historically all-women school, it would be hard to do otherwise - and it's still a problem under Title IX, regardless.
Today, the U.S. Department of Education’s Office for Civil Rights (OCR) opened an investigation into Smith College, one of the nation’s largest all-women's colleges, for admitting biological men and granting them access to women-only spaces, including dormitories, bathrooms, locker rooms, and athletic teams. OCR will determine whether the college violated Title IX of the Education Amendments of 1972 (Title IX) by allowing biological males into women’s intimate spaces.
Title IX contains a single-sex exception that allows colleges to enroll all-male or all-female student bodies—but the exception applies on the basis of biological sex difference, not subjective gender identity. An all-girls college that enrolls male students professing a female identity would cease to qualify as single sex under Title IX.
Because they are no longer a single sex institution. They are admitting men.
“An all-women’s college loses all meaning if it is admitting biological males,” said Assistant Secretary for Civil Rights Kimberly Richey. “Allowing biological males into spaces designed for women raises serious concerns about privacy, fairness, and compliance under federal law. The Trump Administration will continue to uphold the law and fight to restore common sense.”
This action by Smith is a problem on several levels, aside from what sure looks like a blatant Title IX violation.

First, they are, as noted, allowing men - let's dispense with the "biological makes" horse squeeze, shall we? They are allowing men into women's bathrooms and locker rooms, including, presumably, showers. There are many reasons why a young woman may choose to attend an all-women institution, but we can safely presume that young women making that choice would prefer not to be confronted in the showers by the last turkey in the shop.
Second, the sports team aspect. I've written about this time and again; men have undeniable and significant physical advantages over women, and their presence is anathema to the concept of fair competition. Further, while I cannot read minds, I suspect that a lot of these men forcing their way onto women's teams do not, in fact, suffer from gender dysphoria, but rather are taking advantage of a social contagion to gain titles and recognition they could not attain competing fairly, with other men.
This investigation into Smith isn't the first such carried out under the Trump administration. It won't be the last. We're seeing some notions of biological reality, not to mention fairness in sports, returned to the nation, and all I can say is, it's about time.
