WHAT'S ON TAP?
Today on Capitol Hill...
The Senate, on Monday, voted to invoke cloture on the nomination of Eric Chunyee Tung to the 9th Circuit Court of Appeals, moving him one step closer to confirmation. Late Tuesday morning, they'll vote — again — on the clean continuing resolution (CR) (H.R.5371), and then, in the afternoon, on the confirmation of Joshua D. Dunlap for the 1st Circuit Court of Appeals.
There are two meetings/hearings set for Tuesday, as well:
- Senate Armed Services — Hearings to examine the nominations of Austin Dahmer, of Arizona, and Robert Kadlec, of New York, both to be an Assistant Secretary, and Michael Borders, of Florida, to be an Assistant Secretary of the Air Force, all of the Department of Defense
- Senate Intelligence (Select) — Closed business meeting to consider pending calendar business
As noted above, the Senate will vote again today on the clean CR, but there's no indication that the outcome will be any different — perhaps later in the week. In the meantime, Republican House Speaker Mike Johnson (LA-4) continues to drive the message home: This is on the Democrats.
White House What's Up
President Donald Trump has no public events scheduled today. There will be a press briefing with White House Press Secretary Karoline Leavitt at 1:00 PM Eastern.
Also, we must acknowledge this morning's news of the passing of former Vice President Dick Cheney.

The Supreme Court will hear oral argument in two more cases on Tuesday:
- Coney Island Auto Parts v. Burton — Whether Federal Rule of Civil Procedure 60(c)(1) imposes any time limit to set aside a void default judgment for lack of personal jurisdiction.
- Hain Celestial Group v. Palmquist —
- Whether a district court's final judgment as to completely diverse parties must be vacated when an appellate court later determines that it erred by dismissing a
non-diverse party at the time of removal. - Whether a plaintiff may defeat diversity jurisdiction after removal by amending the complaint to add factual allegations that state a colorable claim against a nondiverse party when the complaint at the time of removal did not state such a claim
- Whether a district court's final judgment as to completely diverse parties must be vacated when an appellate court later determines that it erred by dismissing a
We had a couple of developments of note in the Oregon National Guard case on Monday:
- ❌ State of Oregon v. Trump (National Guard deployment) — Judge Karin Immergut (Oregon) issues preliminary injunction until she can render final decision on merits.
- ↔️ State of Oregon v. Trump (National Guard deployment) — Trump administration moves to dismiss appeal to 9th Circuit of original TRO since it has now expired and Immergut has now issued a preliminary injunction.
Also, in response to the district court rulings ordering it to use contingency funding to fulfill SNAP benefits for November, the Trump administration filed a report with the courts detailing its compliance efforts.

COMING ATTRACTIONS
Today, of course, is Election Day in multiple jurisdictions, and we'll be watching the outcomes closely — particularly in California (Prop. 50), New Jersey, New York City, and Virginia — and reporting on them here later this evening.
MORNING MUSING
As noted above, it's Election Day. These are off-year elections, and not every state or municipality is holding them today. (Here in the St. Louis area, there are only elections in select municipalities — not mine — mostly for some form of tax increase. One would hope those don't pass, but their being held when such low turnout is expected doesn't weigh in favor of that.)
But for all the time many of us spend online discussing political ramifications — and offline chewing on them — the key to pretty much all of it is actually exercising our critical (and sacred) right of suffrage. I know most of our readers aren't in California, New Jersey, New York, or Virginia, but many are — and your vote counts, even if you're not overly optimistic of your candidate or position emerging victorious.
Think of it this way: In 2020, Joe Biden (allegedly) received 81 million votes to Donald Trump's 74 million, so Biden got the "win." But setting aside the mountain of questions and doubts surrounding that election, one thing no one could deny was that 74 million Americans (at least) preferred the other guy and held a different vision. Your vote — even when it doesn't back the winning candidate or position — needs to be registered.
Frequently, I see or hear people expressing doubt, characterizing a particular vote/election as a lost cause. I understand the frustration. It can be easy to become discouraged — but don't. If there's an election in your area today, go vote (if you haven't already). Do it.
