WHAT'S ON TAP?
Today on Capitol Hill...
Lucky 13...it wasn't. The Senate again failed to pass the clean continuing resolution (CR) to fund and reopen the government, with no notable change in the vote lineup. So...I guess Minority Leader Chuck Schumer (D-NY) and the Senate Dems are intent on inflicting maximum pain on the American people in the hopes that it will harm President Trump and the Republicans politically. Cynical lot, aren't they?
In other Senate news, five Republicans joined with Senate Democrats to block the president's tariffs on Brazil. On a brighter note, Sen. Eric Schmitt called out the Dems' both-sides BS in a hearing on Tuesday, and the Senate confirmed Jordan Emery Pratt to be United States District Judge for the Middle District of Florida.

On Wednesday, there are several Senate hearings/meetings set, including:
- Senate Energy and Natural Resources — Hearings to examine the Section 106 consultation process under the National Historic Preservation Act
- Senate Health, Education, Labor, and Pensions — Hearings to examine the future of biotech, focusing on maintaining U.S. competitiveness and lifesaving cures to patients
- Senate Commerce, Science, and Transportation — Hearings to examine Big Tech and silencing Americans part 2
- Senate Indian Affairs — Hearings to examine impacts of government shutdowns and agency reductions in force on Native communities
- Senate Veterans' Affairs — Hearings to examine putting veterans first, focusing on the current VA disability system
White House What's Up
After an exciting and productive day in Japan on Tuesday, President Trump is headed to South Korea on Wednesday, where he'll deliver keynote remarks at the APEC CEOs luncheon, participate in a High Honor Presentation, and attend a dinner hosted by the President of the Republic of Korea, Lee Jae Myung.
Vice President JD Vance, who was just in Israel last week, remains optimistic that the Gaza peace deal will hold, despite Hamas' violation of the agreement and Israel's retaliatory strikes.
"The ceasefire is holding. That doesn't mean that there aren't going to be little skirmishes," says @VP.

Sec. Transportation - Sean Duffy — Duffy continues to call out Chuck Schumer and the Senate Dems over the shutdown.

We didn't get many notable decisions on Tuesday from the courts, but this one is sure to raise some eyebrows:
- ❌ State of Oregon v. Trump (National Guard Deployment) — 9th Circuit orders matter to be reheard en banc (thus vacating the panel ruling, which issued a stay pending appeal).
Now, that seems disappointing, after the prior panel ruling, but our friend Shipwreckedcrew has some ideas about what might really be going on — plus, we're still waiting on SCOTUS to weigh in on the Illinois case.
We also had this non-surprising ruling:
- ❌ AFGE v. OMB (shutdown layoffs) — Judge Susan Illston (Northern District of California) GRANTS plaintiffs' motion for preliminary injunction.
Also — finally got the 4th Circuit scorecard completed (and the tally is a bit surprising):

COMING ATTRACTIONS
President Trump is set to meet with Chinese President Xi Jinping in Gyeongju, South Korea, on Thursday. That should be interesting...
Still tapping my fingers, waiting for that Supreme Court decision in the Illinois National Guard case.
MORNING MUSING
You know the flip test, right? Where you take a scenario that's being discussed in the news and imagine how it would be covered if the parties of the key players were reversed. So...imagine the Schumer Shutdown...only it's the Republicans voting against reopening the government.
There's a Democrat president and Democrats control both houses of Congress, albeit with a slim margin. The authorization for funding has lapsed, the new appropriations measures aren't in place, and the Democrats have put forth a clean CR just to extend current spending levels — not increase them — for a few weeks. They got it passed in the House in September. But Senate Republicans are holding the filibuster over the Dems' heads, refusing to vote with them in sufficient numbers to pass the measure in the upper chamber.
The military, air traffic controllers, and federal employees aren't getting paid. SNAP benefits are about to run out. And the Republicans are saying they won't vote to reopen the government unless the Dems agree to cut $1 trillion from the budget.
Who's catching the blame there?
