House Republican Introduces Bill to Limit Use Presidential Autopen — the Bill's Name Couldn't Be Better

As RedState reported on Tuesday, the Trump White House, in coordination with the Department of Justice, has opened an investigation into the widespread use of the executive autopen in the waning days of the Biden administration.

White House Press Secretary Karoline Leavitt went bottom line during comments to Fox News Digital, saying:

Joe Biden was the worst, most incompetent, and senile president in our country's history. It has been widely reported that Joe Biden handed the power of the presidency to an autopen controlled by unelected leftist staffers, who were allowed to make terrible decisions that destroyed our country.

The administration's investigation into Team Biden's abuse of the autopen comes as the Republican-controlled Congress continues its investigation into Biden's cognitive decline while in office.

As exclusively reported by Daily Wire on Wednesday, Republican Rep. Addison McDowell (NC) is introducing a bill, ingeniously titled the “Ban on Inkless Directives and Executive Notarizations Act of 2025 (BIDEN) Act” that would amend Title 3 of the U.S. Code to prevent a president from using an autopen or other such a device for signing bills, executive orders, pardons, and commutations of prison sentences.

McDowell told the outlet:

The American people elect a President to run the country, not a cabal of woke staffers. Sadly, that is exactly what the American people received under Joe Biden.

While Joe Biden worried more about breaking glass ceilings as commander in chief, his legacy will forever be tied to the lack of oversight he provided to the presidential autopen.

The BIDEN Act will ensure that rogue bureaucrats can no longer take advantage of a mentally incompetent President to seize authority awarded to the Oval Office.

McDowell also told Daily Wire that his bill intends to ensure that a president personally signs off on bills, executive orders, pardons, and commutations, while his office also contends that the BIDEN Act would require that any documents signed in violation of the bill, both past or future, would be considered invalid and have no legal effect.

The bill reads, in part:

Section 301 of title 3, United States Code, is amended by adding at the end the following: 

Notwithstanding this section or any other provision of law, no person other than the President may lawfully sign an engrossed bill, Executive Order, or pardon or commutation, nor may [an] automatic signing device, including an autopen, be used for such purpose.

No engrossed bill, Executive Order, or pardon or commutation that was signed in violation of section 3019 of title 3, United States Code, including any such an engrossed bill, Executive Order, or pardon or commutation signed prior to the effective date of this Act, may be considered to have any force or effect.

Why members on both sides of the aisle wouldn't support the above legislation would (or should) be a mystery, given that a future presidential administration from either party could, theoretically, attempt the same abuse as that of the Biden administration.

Then again, deportation of dangerous illegal aliens shouldn't be controversial, either, but here we are.
