Jury in Lindsay Clancy Case Tells the Judge Last Thing He Wants to Hear — This Is Bad

This is the last thing that Americans wanted to hear about the Lindsay Clancy case – including the judge.

The jury in the high-profile Lindsay Clancy murder trial told a Massachusetts judge Tuesday morning that it could not reach a unanimous verdict in the deaths of her three young children.

Judge William F. Sullivan sent the jurors back to continue deliberating after receiving a note saying, “After many hours of deliberation, we are unable to come to a unanimous decision.”

As has been widely reported, at least three female jurors showed up to the courtroom wearing pink, which has been seized on by Clancy's supporters as a sign of "solidarity" with her purported mental illness. 

There are no concrete details that establish this was the reason why the female jurors wore the color.

The latest development came on the fourth day of deliberations after roughly 17 hours behind closed doors. The jury of nine women and three men began weighing the case Thursday following a sprawling trial that lasted more than a month, featured more than 80 witnesses, and included hundreds of exhibits.

Sullivan told jurors to keep working through the evidence rather than immediately declaring a mistrial.

Clancy, 36, a former labor and delivery nurse from Duxbury, Massachusetts, is charged with three counts of first-degree murder in the January 2023 deaths of her children: Cora, 5; Dawson, 3; and Callan, 8 months old.

There is no dispute over who killed the children. Clancy's attorneys acknowledge that she strangled all three with exercise resistance bands after sending her husband, Patrick, out of the house to pick up food and medication. Clancy subsequently cut herself and jumped from a second-story window, suffering injuries that left her paralyzed from the waist down.

The entire case has instead turned on the question of criminal responsibility.

Prosecutors contend Clancy knew exactly what she was doing and acted deliberately, arguing during the trial that she killed the children “intentionally, rationally, and swiftly.”

The defense argues Clancy was suffering from postpartum psychosis and was legally insane when she killed them. Her lawyers have also emphasized her extensive psychiatric treatment and the number of medications she had been prescribed in the period leading up to the deaths.

If jurors reject that defense, they have several possible homicide verdicts to consider for each child, including first-degree murder, second-degree murder and manslaughter.

If they find Clancy not guilty by reason of lack of criminal responsibility (i.e., the insanity defense), however, she would not simply walk out of the courthouse. She could instead remain confined in a psychiatric hospital, potentially for the rest of her life.

That distinction has become the heart of a brutal case that has generated an extraordinary amount of division.

As RedState's Brandon Morse previously reported, Clancy had sought psychiatric treatment before the killings while suffering from insomnia, depression and thoughts of harming her children. But Morse argued that the evidence surrounding the actual killings — including Clancy sending her husband away — pointed toward deliberate conduct that should not be excused by her mental condition. 

The prosecution has focused heavily on similar evidence. Clancy sent Patrick out on errands before the killings and checked how long his trip would take. While he was gone, the three children were strangled one after another in the basement. Those circumstances have formed a critical part of the state's argument that Clancy planned the killings rather than acting without an understanding of what she was doing.

The defense called forensic psychiatrist Dr. Phillip Resnick, who testified that he believed Clancy was psychotic at the time and unable to distinguish right from wrong. 

But the courtroom battle has been accompanied by another, considerably stranger phenomenon.

As I previously noted at RedState, an “I Stand With Lindsay” movement has grown around Clancy, with supporters wearing pink outside the courthouse, selling merchandise and posting emotional TikTok videos expressing solidarity with her. Hundreds of women gathered outside Plymouth Superior Court during the trial wearing shirts carrying messages including “Believe,” “She Needed Help” and “Peace for Lindsay.” 

A fundraiser established for Clancy's parents has also surpassed $1 million, drawing tens of thousands of contributions. 

That social-media movement has at times become detached from even Clancy's own legal defense.

Some supporters have promoted conspiracy theories accusing Patrick Clancy of killing the children, despite evidence placing him away from the home and despite Lindsay Clancy's own attorneys making no such claim. Her defense isn't that somebody else killed Cora, Dawson, and Callan. It is that their mother killed them while legally insane. 

The 12 people in the jury room aren't being asked whether postpartum psychosis exists. It does. They aren't being asked whether Clancy was suffering from serious psychiatric problems. There is extensive evidence that she was.

They are being asked a much narrower legal question about her state of mind when she strangled her children.

For now, at least one juror appears unwilling to join the others on whatever verdict is being discussed. Judge Sullivan isn't ready to give up on them.

If the deadlock persists, the court could eventually give the jury a stronger supplemental instruction urging jurors to reconsider their positions. If they still cannot unanimously agree, the case could ultimately end in a mistrial and leave prosecutors with the decision of whether to try Clancy again.

Her defense attorney, Kevin Reddington, has already indicated he would be prepared to retry the case if necessary.
