Labor Dept. IG Launches Probe on Criminals' Big Business Through H-1B Program

For four years, Americans watched as the Biden administration allowed millions of unskilled illegal aliens into the country to do what we were told were "the jobs that Americans won't do." But there is another side to the issue of immigrant workers that has slid under the radar for years. That is the H-1B visa program. But in many cases, it has become the big business of criminal networks, so much so that Anthony D'Esposito, Inspector General at the Department of Labor, has launched an investigation into what is going on.

D'Esposito could not reveal too much of the ongoing investigation. But he did speak about what he thought would make Americans the angriest, and perhaps get lawmakers to move on it quickly: the business of criminal networks literally selling H-1B visas.

“This is not just fraud: This is a criminal enterprise that stretches far beyond the borders of America,...the fact that many of the individuals that you’re talking about that are selling these jobs, getting kickbacks. We will clearly outline and define their relationships with — whether it’s gangs [or] whether it is transnational criminal organizations."

Currently, the H-1B visa program retains roughly one million non-immigrant foreign workers in the U.S. who are employed in jobs that are sought after by American college graduates. The investigation was launched in July as part of Vice President JD Vance's Task Force to Eliminate Fraud project. The H-1B program imports around 120,000 workers annually, and most are employed by Fortune 500 companies, staffing subcontractors, and other companies. Universities, hospitals, and nonprofits can bring as many H-1B holders into the country as they want.

They can extend the visas in three-year increments as many times as they want, and don't have to offer those jobs to American workers. Then, there is the bonus of the government providing work permits to spouses, which brings the total number of jobs held by those imported workers to about one million, and sends American workers to the back of the line.

If you are a foreign worker, an H-1B visa is as good as gold. It allows immigrant workers to earn higher wages than they could ever earn in their home countries. They also get the professional benefits of work experience and potential promotions; it also allows them the opportunity to enjoy life in American suburbs, birthright citizenship for any children born in the U.S., and a path to naturalization. Until now, there has not been much oversight of these foreign workers and visa worker programs. But the Trump administration is changing that.

There is also the practice of companies offering to keep H1-B visa holders on at a much lower pay rate after their visa has expired. The foreign workers are often threatened with exposure by the company as being illegal if they do not agree to lower pay.

The toll the H-1B visa criminal enterprise is taking on American workers is gaining awareness. The underemployment rate for new U.S. college graduates is at around 40 percent. The combined unemployment and underemployment rate for computer science grads is at 26 percent. However, D'Esposito says that the investigation is focused on the labor market, not the immigrants, saying, “I don’t think that the individuals in every case are the bad guys.” He placed the blame at the feet of the government and employers.

American companies are taking advantage of one of many broken visa programs at the expense of American workers. Anthony D'Esposito put it bluntly: "I think that they (foreign workers) are being utilized as pawns in a seriously dangerous operation."
