As we previously reported, former President Donald Trump was indicted over allegedly holding on to classified documents from his presidency as part of an investigation by Special Counsel Jack Smith in June. He pled not guilty to the 37-count indictment. And as my colleague Mike Miller wrote earlier on Thursday, Trump’s legal team met with the Special Counsel in anticipation of another indictment.

Now, Fox News is exclusively reporting that Trump has been charged with three additional counts:

Trump, who is atop the 2024 GOP presidential primary field, was charged Thursday with an additional count of willful retention of National Defense Information and two new obstruction counts as part of a new “superseding” indictment out of Special Counsel Jack Smith’s investigation into his alleged improper retention of classified records.

Trump spoke to Fox News Digital about the breaking news of the new charges from the DOJ—and he didn’t hold back, calling it “election interference at the highest level” and “prosecutorial misconduct”:

It’s election interference at the highest level. They’re harassing my company, they’re harassing my family and by far, least importantly of all, they’re harassing me….the charges are ridiculous, and they know it better than anyone.

This is prosecutorial misconduct used at a level never seen before. If I weren’t leading Biden by a lot in numerous polls, and wasn’t going to be the Republican nominee, it wouldn’t be happening. It wouldn’t be happening.

But I am way up as a Republican and way up in the general election and this is what you get.

He continued, saying, “Our country is suffering from DOJ abuse,” while adding that “[h]opefully the Republican Party will do something about it.”

Earlier on Thursday, there was news that, in addition to the former president and Trump valet Walt Nauta, the Special Counsel has now charged a third person—Mar-a-Lago’s head of maintenance Carlos De Oliveira—in the classified documents case.
