Maine, Defiant: Federal Judge Orders Trump Admin to Unfreeze Federal Funding over Trans Athletes

It's rather amazing, the lengths to which some people will go to ensure that mediocre biologically male athletes retain the option to claim to be women and become outstanding female athletes. It's probably not even an 80-20 issue that the pro-dudes-in-women's-sports contingent is on the wrong side of; it's probably more like a 95-5 issue. But they are sure keeping up the fight to allow this hideously unfair practice, not least of all in Maine, where Governor Janet Mills has been openly defiant.

President Trump moved to incentivize Maine by cutting off federal funding. Now, a federal judge is ordering the Trump administration to restore that funding.

A federal judge said the Trump administration must lift the freeze on federal funding to Maine.

The ruling reads that the USDA "must immediately unfreeze and release to the state of Maine any federal funding that they have frozen or failed or refused to pay because of the state of Maine's alleged failure to comply with the requirements of Title IX."

The administration is also "barred from freezing, terminating, or otherwise interfering with the state of Maine's future federal funding for alleged violations of Title IX without complying with the legally required procedure."

There's an important point to be made here: A reading of the actual decision reveals that the fairness of the practice of letting boys and men in girls' and women's sports was not evaluated, nor were President Trump's revisions of the regulations interpreting Title IX to disallow that practice. The decision was made on procedural grounds:

This lawsuit raises two primary questions, both narrow: (1) if the USDA wishes to withhold appropriated funds to a state, whether there are regulatory steps it must follow before doing so, and (2) in the instant case, whether the Federal Defendants complied with those procedures. The Court quickly resolved these questions in favor of the State.

So, it would appear, at least to this layman, that if USDA follows the procedures dictated by regulation, then they could remove said funding and Maine would no longer have a case, and it's a safe bet that is already being evaluated. Say what you will about President Trump, he doesn't give up easily, and he and his administration have been insistent on this issue.

The USDA announced the funding freeze and a review of federal funding to Maine earlier this month after the state refused to provide equal opportunities to women and girls in educational programs.

The state has refused to comply with President Donald Trump's February executive order to ban trans athletes from girls' and women's sports, prompting immense federal pressure. Trump initially vowed to cut federal funding to the state if it were to refuse to comply with the order during a Feb. 20 speech.

Maine is, nevertheless, on the catastrophically wrong side of this issue, and while the Trump administration can place pressure on Maine's school and university systems, ultimately, it will be up to the Maine voters to set this matter to rights. 

And this does need to be set to rights. In February, a "transgender" athlete chalked up another illegitimate win to which he is not entitled.

This cannot continue. Maine, and indeed every state, needs to start stamping the brakes on this stupidity.
