WHAT'S ON TAP?
Today on Capitol Hill...
Again, it being Turkey Week, no hearings or meetings are set on the Hill on Tuesday. There have been murmurs about possible plans to attack the Obamacare subsidies issue, with a possible plan from the White House involving a pared back extension being floated, but then seemingly pulled back. As part of the deal to end the Schumer Shutdown, Senate Majority Leader John Thune (R-SD) promised a vote on the subsidies by December 12. Here's what Punchbowl has to say about the current state of play:
There’s always been a distinct possibility that Thune’s promise of a vote simply becomes a messaging exercise for Democrats whereby they all vote for a clean extension of the subsidies, it falls well short of 60 votes, and everyone moves on with their lives.
The alternative, of course, is a compromise product that extends the Obamacare subsidies in some form. A key unknown variable here is what exactly the coalition looks like to win 60 votes. Is it nearly every Democrat and a handful of Republicans? Or vice-versa? Or is it more like 30-40 senators from each party?
If the starting point is a Trump-backed bill, the vast majority of the Senate GOP Conference will likely support it. The question is whether there are enough Democrats to supply 60-plus votes. Last week, top Senate Democrats were publicly casting doubt on the prospects of an Obamacare extension deal, while many progressives probably won’t vote for anything that isn’t a clean extension.
It’ll be a similar calculation in the House, where Johnson would likely need a good chunk of Democratic votes to make up for the Republicans who will never vote for an Obamacare extension even with Trump’s prodding.
That dynamic would be tricky territory for Johnson. Republican speakers of the House are sensitive to criticism that they are relying on Democrats to pass legislation. Johnson also likes to say that his job is to build consensus among Republicans.
Let's add to the mix the recognition that Speaker Mike Johnson's (LA-04) slim margin is in danger of becoming even slimmer between Rep. Marjorie Taylor Greene (GA-14) announcing her resignation come January and Rep. Don Bacon (NE-02) rumored to be threatening resignation over his dissatisfaction with the proposed Russia-Ukraine peace plan. The special election to replace Republican Mark Green in TN-07 is next Tuesday and Republican Matt Van Epps is thought to have a decent lead over Democrat challenger (and seeming whackadoo) Aftyn Behn, but it's never wise to count chickens before they're hatched. Johnson's pulled a few rabbits out of his hat during his tenure — he's likely going to need a few more to navigate these next few weeks.
White House What's Up
On Tuesday at noon, President Trump and First Lady Melania will participate in the annual Turkey Pardon ceremony in the Rose Garden. In the evening, they'll depart the White House and head to Mar-a-Lago, where they'll spend the Thanksgiving weekend.
Keeping Up With the Cabinet
Sec. Labor - Lori Chavez-DeRemer — Chavez-DeRemer and the Labor Department recently shared the White House announcement that all jobs created in the U.S. since President Trump took office have gone to native-born Americans, for the first time in decades.

A couple of court rulings of note on Monday:
- ✅ Harper v. Bessent (removal of independent agency leaders - National Credit Union Administration Board) — the Supreme Court DENIES petitioners' request for writ of certiorari.
- ❌ Democracy Forward Foundation v. DOJ (FOIA request/retention of records re: handling of Epstein files) — Judge Tanya Chutkan (D.C.) GRANTS in part and DENIES in part plaintiffs' motion for summary judgment. Initially, I intended to rate this one a ↔️ since the ruling is a partial grant and partial denial, but the ruling orders the administration "to expedite processing of Democracy Forward’s July 25 and July 28 FOIA requests, except with respect to the overbroad search terms “whistleblower” and “flight logs.” In other words, on balance, it's a win for the plaintiffs.
The big news, of course, was the dismissal of the indictments against James Comey and Letitia James on the basis of Lindsey Halligan's appointment as U.S. Attorney in the Eastern District of Virginia being improper. White House Press Secretary Karoline Leavitt affirmed late Monday afternoon that the administration would be appealing that ruling.

Chalk Up Another Win at SCOTUS for the Trump Administration
We also saw the DOJ seek leave (again) to unseal the grand jury transcripts and exhibits in the Jeffrey Epstein and Ghislaine Maxwell cases. We'll be keeping an eye out for those rulings as well.
MORNING MUSING
As Bob Hoge noted in his follow-up article regarding the dismissal of the indictment against James Comey, the former FBI Director issued another holier-than-thou video reacting to the dismissal.

The whole two-plus minutes is annoying dreck, but this was the part that got me:
"This case mattered to me personally, obviously, but it matters most because a message has to be sent that the President of the United States cannot use the Department of Justice to target his political enemies. I don't care what your politics are — you have to see that as fundamentally un-American and a threat to the rule of law that keeps all of us free."
That's right rich coming from one of the key players in the cabal that has, for years, done exactly that, aiming not just at Donald Trump but Republicans and conservatives. You don't get to twist the rule of law into pretzel knots and then squeal when you get served the same.
I'd love for us to get back (or forward) to a place where we can all not only agree on the importance of the principle of blind justice and on not allowing the DOJ — or any element of the government — to be weaponized against U.S. citizens for political/partisan purpose. Sign me up.
But for Saint "8647" Comey to play at championing those ideals when he's been one of the worst offenders trampling them is a crock.
Save it for your next book, Jim. I'll be sure not to buy it.
