Even an en banc panel will have a difficult time not upholding the three-judge opinion — especially when judges openly express that Hawaii keeps trying to invalidate every challenge to their laws via moot attempts.

We had a couple of notable decisions over the weekend, including:
- ✅ In Robert F. Kennedy Human Rights v. DHS (closure of oversight offices), Judge Ana Reyes (D.C.) DENIES plaintiffs' motion for reconsideration (of denial of preliminary injunction).
- ❌ In C.M. v. Noem (Alligator Alcatraz/access to attorneys), Judge Sheri Polster Chappell (Middle District of Florida) partially GRANTS plaintiffs' motion for preliminary injunction and GRANTS motion for class certification.
The Supreme Court will hear oral argument in two cases today:
- Abouammo v. United States —
- 1. Whether venue is proper in a district where no offense conduct took place, so long as the statute's intent element "contemplates" effects that could occur there.
- 2. Whether a criminal information unaccompanied by a waiver of indictment is an
"information charging a felony" that allows the government to unilaterally extend the statute of limitations under 18 U.S.C. § 3288.
- Jules v. Andre Balazs Properties — Whether a federal court that initially exercises jurisdiction and stays a case pending arbitration maintains jurisdiction over a post-arbitration Section 9 or 10 application where jurisdiction would otherwise be lacking.
COMING ATTRACTIONS
The big argument at SCOTUS comes on Wednesday as the High Court takes up the birthright citizenship case.
And the White House has announced that the annual Easter Egg Roll will take place next Monday, April 6.
