The House is still out, and the Senate is still a no on the continuing resolution to reopen/fund the government. On Tuesday, the Senate has five meetings/hearings set:
- Senate Judiciary — Oversight hearings to examine the Department of Justice [Attorney General Pam Bondi to testify]
- Senate Armed Services — Hearings to examine the nominations of John Noh, of Texas, to be an Assistant Secretary, Charles Young III, of West Virginia, to be General Counsel of the Department of the Army, and William Lane III, of Virginia, to be General Counsel of the Department of the Air Force, all of the Department of Defense, and David Beck, of Tennessee, to be Deputy Administrator for Defense Programs, National Nuclear Security Administration, Department of Energy
- Senate Foreign Relations, East Asia, the Pacific, and International Cybersecurity Policy Subcommittee — Hearings to examine combating the People's Republic of China's behavior in the Indo-Pacific
- Senate Armed Services, Emerging Threats and Capabilities Subcommittee — Hearings to examine on threats and challenges posed to Department of Defense personnel and operations from adversarial access to publicly available data coupled with advanced data analysis tools now widely available on the commercial market
- Senate Intelligence (Select) — To receive a closed briefing on certain intelligence matters
White House What's Up
On Tuesday, President Trump meets and has lunch with Canadian Prime Minister Mark Carney late morning. In the afternoon, he'll meet with former hostage Edan Alexander.
Keeping Up With the Cabinet
Admin. Small Business Administration - Kelly Loeffler — Loeffler shared a post on X describing the historic number of loan approvals made by the SBA in FY25, noting also the effect the Schumer Shutdown is having on that flow of capital.
The Trump SBA just announced the most loan approvals in its 72-year history, with 85K loans totaling $45B in capital for small businesses to expand and hire.

Full Court Press...
Day 2 of the 2025 term for the Supreme Court features oral argument in two more cases:
- Chiles v. Salazar — Whether a law that censors certain conversations between counselors and their clients based on the viewpoints expressed regulates conduct or violates the Free Speech Clause.
- Barrett v. United States — Whether the Double Jeopardy Clause permits two sentences for an act that violates 18 U.S.C. § 924(c) and§ 924(j), a question that divides seven circuits
but about which the Solicitor General and Petitioner agree.
The court also handed out a lengthy order list, granting certiorari (or other relief) in some cases, but denying it in others, including as to Ghislaine Maxwell's appeal.
There were a handful of notable court decisions on Monday, including:
- ❌ NH Indonesian Community Support v. Trump (birthright citizenship) — 1st Circuit Court of Appeals AFFIRMS preliminary injunction in part, but VACATES that portion that purports to apply to the president himself. (That last bit is a "win" of sorts, but almost an automatic, so this one is more loss than win.)
- ❌ Abramowitz v. Lake (reduction of federal bureaucracy) — D.C. Circuit Court of Appeals DENIES admin's motion for stay pending appeal.
- ↔️ U.S. v. Comey (lying to Congress, obstruction) — Judge Michael Nachmanoff (Eastern District of Virginia) moves up the date of arraignment one day (to Wednesday). (This one's neither loss nor win, just notable.)
COMING ATTRACTIONS
We're still waiting to see what comes of Gaza peace talks and the Schumer Shutdown.
On the court front, we'll be keeping a close eye on what the 9th Circuit does in the Oregon National Guard case.
MORNING MUSING
There are some things it's just impossible to fathom. Hamas' attack on Israel on October 7, 2023, is one of those things. I will never understand the sheer barbarity of that day — and I don't want to.
The fact that it's been two years since that awful day — and there are still hostages being held — is one of those things. I know there's a glimmer of hope that they will soon be returned. I hold onto that hope. But they should have been home long ago. They should never have been taken.
That, following the horrific attacks, we saw a rise in antisemitism is one of those things. The level of animosity directed at Jewish people, the attacks even here in the U.S., the calls for global intifada, the effort to blame any and all things on Israel and the Jews — miss me with that.
It feels overly simplistic to just attribute it all to evil — or sin. But I don't know how else to describe it. What I do know is that it needs to end. The hostages need to come home, and Hamas needs to be rendered powerless. Yesterday.
