Though everyone is, of course, entitled to express their own partisan opinions about things, it is frowned upon when you're a member of the judiciary because, in theory, judges are supposed to be impartial and are definitely not supposed to be seen as putting their thumb on the scale one way or another on any given issue.
But in North Carolina, as in many other parts of the country, there are woke judges and justices who won't hesitate to do just that, apparently thinking their Democrat Privilege makes them immune from potential repercussions among their colleagues and, more importantly, ethics boards.
This is something we saw play out in the contested 2024 NC Supreme Court race earlier this year, and is something North Carolina has seen in action yet again amid the immigration sweeps that have taken place in Charlotte and other parts of the state over the last week.

As one would expect, opinions vary greatly across the Old North State on the Customs and Border Patrol's (CBP) increased presence, with arguments breaking out in neighborhoods and on the Nextdoor App as to whether the round-ups are right or wrong to do. While I'll spare you too many details on what has passed for "facts," let me just say that I've seen more than a few "we're on stolen land" claims, with the insinuation clear that we are all supposedly here "illegally" and should therefore leave illegal immigrants alone.
But back to the NC Supreme Court, absolutely no one familiar with how things work on the left here in North Carolina will be shocked to learn that Senior Associate Justice Anita Earls (D), who is up for reelection in 2026, has come out strongly against Operation Charlotte's Web, calling it a a "violation of constitutional rights" and one that has supposedly taken federal agents away from solving crimes like sex trafficking and child abuse (as if those types of criminal illegals are not among the over 300 that have been arrested).
Towards the end of her statement, Earls accused the Trump administration, without evidence, of using "immigrants" as "scapegoats."
"This type of political stunt further erodes the public's trust in the already broken justice system," Earls also wrote in perhaps one of the least self-aware statements ever made in modern judicial history.

Earls making a wildly partisan statement on an issue that potentially could come before the state's highest court at some point was not lost on her conservative colleague, Associate Justice Phil Berger, Jr., who correctly pointed out the irresponsibility of her statement:
"What undermines public confidence is not lawful enforcement activity, but the growing trend of judges asserting their personal opinions and positions without facts, without parties before them, and without the neutrality their office demands. Judges are not political commentators, and we are not supposed to be advocates. When we speak as if we are, we blur boundaries."

The current make-up of the NC Supreme Court is 5-2 GOP, and Democrats are desperate to get control back via the 2026 and 2028 election cycles, before the 2030 Census and the inevitable redistricting that will again take place.
Earls, who has previously faced ethics questions related to partisan statements, is undoubtedly doing this as part of a "rally the troops" campaign tactic to let her supporters know she's on their side, wink-wink.
Whether or not this ultimately helps her politically remains to be seen, but Earls has sent yet another chilling signal to every conservative in this state who will now have one more reason to wonder if any case they potentially have to bring before the court in the event it flips back to Democrat control will get a fair hearing.
