Texas Supreme Court Rules Against Father Trying to Prevent Gender Transition of His Son

We previously reported on the heartbreaking story of Jeff and James Younger. Now, it looks like there may be more bad news.

James is Jeff’s young son. But Jeff Younger has been fighting James’ mother for years in a variety of custody battles because his mother Anne Georgulas claims that James is a girl named Luna. As we reported, multiple witnesses indicated that James seemed to act more naturally as a boy. Georgulas took James and his brother Jude to California, and Jeff is afraid that in California, his mother will subject him to transgender procedures to transition him. Georgulas is a pediatrician; Younger believes that she is using the situation with her child to help her “gender-affirming” practice.

Younger petitioned the Texas Supreme Court to have the boys returned to Texas because he is concerned about a California law, which will take effect in January, that he believes will adversely impact his son. That law will “prohibit the enforcement of an order based on another state’s law authorizing a child to be removed from their parent or guardian based on that parent or guardian allowing their child to receive gender-affirming health care or gender-affirming mental health care.”

Jeff Younger’s petition states that if allowed to stay in California, his son “would be subjected to transgender procedures deemed to be child abuse by official opinion of the Texas Attorney General.”

Since last year, the State of Texas has investigated instances of gender transition surgery as “child abuse” under the penal code. That investigation was extended to puberty-blocking drugs in February after the Office of the Attorney General (OAG) issued a non-binding legal opinion supporting the contention that it meets the standard of “child abuse.”

Without intervention by the court, Younger states, “The Children would lose the protections of injunctions on the Mother that prevent her from chemically castrating the Children or sexually mutilating them in transgender surgeries.”

James has not yet been subjected to any transition procedures, although he is treated as a girl by the mother with whom he is living.

But now, the Texas Supreme Court has denied the order to have the sons returned to Texas.

While the mother was given full custody of James in August 2021, she was still required to get consent from Younger as to any decisions on such things as puberty blockers or gender reassignment.

The Court said that because of that Texas order, the mother would be prevented from transitioning the child without the permission of the father and that she could not avoid the order because she had moved to California.

Younger believes that the Texas order wouldn’t be enough, that the mother will be able to get around the Texas order in California; he was trying to act to prevent that before it was too late.

It’s not hard to understand the father’s concerns, although the Court did not “terminate his parental rights.” He’s afraid those rights will mean little if the mother takes action, regardless of the Texas order. Given what we’ve seen in California, it’s understandable that he doesn’t want to pin everything on people in California paying attention to the Texas order. And unfortunately, there’s a little boy in the middle of all this, who is most at risk in this fight.
