BREAKING: Supreme Court Upholds Pence Decision On Indiana Abortionist's Handling of Fetal Remains

Not long ago, then Governor of Indiana, Mike Pence, signed into a law a requirement that would force abortion clinics to bury or cremate the remains of aborted babies. After a lower court had reversed the decision, it would appear the Supreme Court is upholding Pence’s law.

According to The Hill, Tuesday’s Supreme Court decision has now allowed the law to take effect:

The law – signed by then-Gov. Mike Pence (R) – required that the fetal remains from abortions be buried or cremated. The court reversed a ruling from the Seventh Circuit of Appeals that found the law unconstitutional.

“We reiterate that, in challenging this provision, respondents have never argued that Indiana’s law imposes an undue burden on a woman’s right to obtain an abortion,” the court’s order reads.

The law came about around the same time Pence had Indiana Planned Parenthood locations investigated after a 2015 undercover video suggested that the organization was trafficking in fetal remains. Pence had directed the Indiana State Department of Health to investigate the abortion provider.

“Every Hoosier should be deeply troubled by allegations that Planned Parenthood affiliates are engaged in the trafficking of human remains. If true, this is not only illegal, it is morally reprehensible. Under federal and state law, the buying or selling of human body parts is a felony and, as Governor, I have an obligation to make sure this is not happening in Indiana,” Pence said.

“For this reason, I have directed the Indiana State Department of Health to conduct an immediate investigation with the cooperation of the Office of the Attorney General of Indiana to determine whether Planned Parenthood affiliates in Indiana have engaged in any illegal activities with respect to the trafficking in or disposition of fetal tissue. Whatever one’s view on the issue of abortion, Hoosiers can be assured that we will make certain that this appalling practice is not taking place in Indiana.”

Investigations found that there were no violations, however, the state of Indiana will still maintain the law, which now treats the aborted babies the same as anyone else who died.

A victory, but a victory pro-lifers wish we didn’t have to have.
