Speaking from the Oval Office on a video released Tuesday, President Trump had some pretty harsh words for former President Barack Obama. Of course, this is nothing new; he has had many harsh words for the former president, from the 2016 campaign to date. But President Trump is now using some new terms, rather directly - like "treason" and "guilty."

President Trump said:
If you look at that, those papers, they have him stone cold. And it was President Obama. It wasn't lots of people all over the place; it was them, too, but the leader of the gang was President Obama, Barack Hussein Obama. Have you heard of him? And except for the fact that he gets shielded by the press, for his entire life, that's the one they... Look, he's guilty. It's not a question. I like to say, let's give it time, but it's there, he's guilty. They... this was treason, this was every word you can think of. They tried to steal the election, they tried to obfuscate the election, they did things like nobody has ever even imagined, even in other countries. You've seen some pretty rough countries, and he's seen some pretty rough countries, but you've never seen anything like that.
And we have all of the documents, and from what Tulsi told me, she's got thousands of additional documents coming. So, President Obama, it was his concept, his idea, but he also got it from crooked Hillary Clinton. Crooked as a three-dollar bill.
This is only one part of an enormous document dump that is far-reaching and, in a lot of cases, startling. And it's nowhere near over yet.

The question becomes, what happens now? Will the Trump administration bring charges against a former President of the United States?
If they do, treason seems a bit of a stretch, constitutionally speaking. Article 3, Section III, of the United States Constitution defines "treason."
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.
Despite President Trump's comments, it appears that levying a charge of actual treason is a tall order, as the wording of Section III appears to define only a wartime offense. The only statement Section III makes on punishment involves restricting it only to the person who committed the act, not to family members:
The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted.
It would be roundly satisfying, although unlikely, to see former President Obama asked to appear before Congress and answer some rather pointed questions about this. His campaign and presidential staff members, and cabinet members, though; that's a lower bar to hurdle.
