It means the district court has to revisit the issue and consider that the case should have been removed to federal court — meaning it was improperly tried in state court — which could mean that the convictions ultimately don't stand. Thursday was a wildly busy day in the courts:
- ✅ State of NY v. Trump (falsification of business records) — 2nd Circuit Court of Appeals VACATES district court order denying Trump leave to file second notice of removal (removing case from state court to federal court).
- ✅ Orr v. Trump (transgender passport policy) — Supreme Court GRANTS administration's application for stay.
- ❌ Chicago Headline Club v. Noem (National Guard deployment/immigration enforcement) — Judge Sara Ellis (Northern District of Illinois) GRANTS plaintiffs' motion for preliminary injunction, as well as plaintiffs' motion for class certification.
❌ Rhode Island State Council of Churches v. Rollins (SNAP benefits) — Judge John McConnell Jr. (Rhode Island) GRANTS plaintiffs' motion to enforce TRO and for second TRO.
Federal Judge Orders USDA to Fully Fund SNAP Program
MORNING MUSING
They say you can't get blood for a turnip, but Rhode Island District Court Judge John McConnell Jr. is doing his damnedest. As we reported yesterday, McConnell issued another order in the case regarding SNAP benefits, this time, insisting that the Trump administration fund the SNAP program — in full — by today.

Never mind that this would entail forcing the USDA to pull money from other programs. Never mind that the SNAP program itself arguably ceased to exist as of September 30. Never mind that, even if it were legal and appropriate to combine the contingency fund with funds from WIC (Special Supplemental Nutrition Program for Women, Infants and Children), that would deplete those programs/funds and do nothing to address following months. Never mind that the sole reason the program's funds are not available is that Senate Democrats won't vote to reopen the government.
No. Forget all of that. Judge McConnell has decreed that the USDA must cobble together funds — legal and practical impediments be damned — and do it now.
The administration has — rightly, in my view — appealed McConnell's orders to the 1st Circuit Court of Appeals, and we can expect, at minimum, a ruling sometime today on an administrative stay. (The appellate court should issue one, but this is a court that hasn't been ruling in favorable fashion to the administration, so I'm not holding my breath on that.)
And it isn't that I'm heartless or want people to go hungry. It's that I want our Constitution and our laws to be followed. I want Congress to do its job. And I want the judiciary to do its job. Because if they continue on this path, they're going to force the administration to call their bluff. And when/if that happens, it's not going to be pretty. The system works (somewhat) when the branches stay in their lanes and use their lawful powers to check one another. But of the three branches, it's the judicial branch that, truth be told, has no teeth. And McConnell and his indignant cohorts are about to expose that for all the world to see.
