Full Court Press...
I don't even know what to say about Tuesday and the courts, other than it wore me out. I reported on three of the notable decisions handed down:
- Breaking: Federal Judge Finds Trump Admin's L.A. National Guard Deployment Violated Posse Comitatus Act
- That's a Win: D.C. Circuit Vacates Lower Court Injunction on Admin's Clawback of $16B in EPA Grants
- Breaking: 5th Circuit Rules Against Trump Admin on Its Use of AEA to Remove TdA Members
The fourth involved another of the "removal of independent agency leaders" cases — this one at the Federal Trade Commission. The D.C. Circuit Court of Appeals (which handed the Trump administration a win on the EPA grants) denied the administration's motion for a stay of a lower court ruling on the removal of Rebecca Slaughter as an FTC commissioner, effectively requiring her to be reinstated while the case plays out on appeal. As Margot Cleveland notes in her tweet, that will be appealed and likely sets up a head-on collision with the Supreme Court precedent of Humphrey's Executor (which is necessary), so, in the long run, this one seems more likely than not to work out for the administration.

One last legal note: That L.G.M.L. case involving the Guatemalan children has been reassigned from Judge Sparkle Sooknanan (Biden) to Judge Timothy Kelly (Trump) — the reason behind the reassignment is unclear. (And speculation as to the why would be just that — there could be a juicy/interesting reason, or it could just be an administrative move to balance out caseloads.)
COMING ATTRACTIONS
With Nigel Farage and others testifying before the House Judiciary Committee today on Europe's (and in particular, the UK's) crackdown on free speech, one wonders whether President Trump might pipe up on the issue ahead of his visit to the U.K., slated for mid-September.
MORNING MUSING
We're all familiar with the term (and likely the novel that spawned it) "Catch-22." Wiki defines it as, "a paradoxical situation from which an individual cannot escape because of contradictory rules or limitations."
It occurs to me that President Trump has pretty well mastered the art of what I'll call the Catch-47: Democrats are hellbent to oppose him on any and all issues. Thus, all he need do is stake out territory on a popular position, expound upon it with some provocative rhetoric, and they'll fall all over themselves to rail against said popular position and paint themselves into an awkward corner.
- Immigration/border security
- Crime
- Men/boys in women's/girls' athletics/spaces
- Wasteful government spending
You name it.
So, while Trump is helping secure his legacy — and fostering the success of his likely successor(s) — he's also helping to kneecap the GOP's current — and future — opposition.
Which, as noted, I shall henceforth refer to as the "Catch-47." (And if that catches on, you'll know you read it here first!)
LIGHTER FARE
I've heard those words before! (But dang if this doesn't make me miss my Hurricane and Stormy — see pic below.)
