Fox News host Mark Levin dedicated Sunday’s episode of “Life, Liberty & Levin” to the presidential election, including laws that were changed prior to the election, specifically in Pennsylvania — and how they were changed, which Levin charged violated the U.S. Constitution — which was where he began his opening monologue.
“I want to talk to you about the battleground state called the Commonwealth of Pennsylvania. It has one of the oldest legislatures in our country, and one of the oldest constitutions in our country.
“We all know Philadelphia is the birthplace of the country, that’s where the Declaration of Independence was written, that’s where the Constitution was written. It’s a very, very important battleground state.
“And the Democrats wanted to make sure that in 2020, it came out for Biden. Because in 2016 it came out for Trump.”
Republican Sean Parnel, who lost his race in Pennsylvania’s 17th Congressional District to incumbent Rep. Conor Lamb, tweeted a clip of Levin’s monologue, which he described as “a perfect summary of our lawsuit.”

Levin began by taking a shot at the media and others who insist there is no evidence that “systemic fraud” occurred in the election, by ticking through several examples of what would have constituted fraud in Pennsylvania just 14 months ago.
“You hear this phrase ‘systemic fraud,'” he said, then mocked: “There’s no evidence of systemic fraud. You see reporters interviewing officials of various state government saying there is no fraud whatsoever.”
“Let me ask you a question. Fourteen months ago in the state of Pennsylvania, if you had voted by mail-in ballot, it would have been discarded. If that mail-in ballot have been counted, that would have been fraud.”
“Fourteen months ago in the state of Pennsylvania, if you sent in a ballot without a signature, that ballot would be discarded. If it was counted, that would be criminal fraud.”
“Fourteen months ago in the state of Pennsylvania, if you sent in a ballot with a signature that did not match the signature they had on file, that would be discarded. If it was counted, there would be fl fraud.”
“Fourteen months ago in the state of Pennsylvania, if you sent in a ballot beyond election day, it wouldn’t be counted and if it was, that would be fraud.
“And if you sent in a ballot without a postal stamp date on it, it wouldn’t be counted or it if it was, that would be fraud.
“Or if you sent a ballot where they couldn’t tell with the date was, because maybe there was a smudge on the ink, it wouldn’t be counted. If it was counted, that would be fraud.”
“All of those ballots today count. They were all counted in Pennsylvania because of unconstitutional and illegal changes that were made by officials and made quote unquote ‘officially’ by individuals in Pennsylvania.”
“None of this is discussed in a single newsroom in America, on a single TV show, radio show, or any other show, Levin chided. “So I want to slowly walk you through what took place in Pennsylvania, and this sort of thing has taken place to some degree or another in numerous states.”
“October 2019. Fourteen months ago. The Republican State Legislature in Pennsylvania passed an omnibus bill called ‘Act 77.’ In Act 77 they included language changing their election laws to allow universal mail-in voting.
“The problem is, Pennsylvania being an old state, having an old constitution, one of the original state legislatures, didn’t allow that. There wasn’t even early voting in Pennsylvania.
“The only way you could have a mail-in vote was through the absentee ballot — and you had to go through a multi-step process there in order to get an absentee ballot.”
He then went after the notion that Pennsylvania and other states loosened their election laws due to COVID — which the Democrats and their state media told us, ad nauseam.
“Well you might say, ‘What about COVID-19?’ In October 2019 there was not COVID 19, was there? There was no virus. This push for mail-in voting has been going on with the Democrats for at least a decade.
“One of the first places they imposed it was in California, among other places. They’ve tried to do this in every state.
“So the Republican State Legislature in Pennsylvania buckled. […] The Democrat governor, who’s a leftist, signed it immediately.
Levin said the governor of Pennsylvania (Tom Wolf) didn’t think Act 77 “went far enough,” so he went to the legislature and whined about signature requirements, postmark requirements, that ballots had to be in by Election Day, and that the state needed several extra days to count ballots, but the Republican-controlled legislature refused.
So Wolf went to the Pennsylvania Supreme Court (of course, they did), in which the Democrats have a 5-2 majority, three of whom are “hardcore leftists,” Levin said.
Lo and behold, several months before the election, Levin said, the Pennsylvania Supreme Court gave Wolf everything he wanted, including no signatures requirements, no signature comparisons, no postmark requirements, and extended time for vote-counting.
Just one problem, Levin pointed out.
“They had no legal or Constitutional basis for doing any of that,” Levin said; they violated Article II, Section 1, Clause 2 of the U.S. Constitution which leaves the power to the state legislature to make election laws.”

As reported Sunday night in an article titled Election Expert Tells Mark Levin Biden Win Not ‘Impossible,’ Then Tosses in the ‘Very Strange’ Stuff That Had to Happen if He Did, pollster and election expert Patrick Basham, who was Levin’s first guest, told Levin that while it’s not “statistically impossible” that Joe Biden won the presidential election, it is “statistically implausible” that he did so.
“Something very strange happened in America’s democracy in the early hours of Wednesday, November 4, and the days that followed. It’s reasonable for a lot of Americans to want to find out exactly what.
If we are to accept that Biden won, against the trend of all these non-polling metrics, it not only means that one of these metrics was inaccurate this time, for the first time ever. It means that each one of these metrics was wrong for the first time and at the same time as all the others. It is not statistically impossible, but it is statistically implausible.”
