I'm not suggesting Elon Musk took my advice when I said he should consider suing Jamaal Bowman, but I'm not denying it either.
As I wrote on Friday, Bowman launched into a deranged rant against Musk, accusing him of being a "thief" and "nazi." It was so bad that CNN's Abby Philip had to jump in and give a disclaimer at the end, stating that his opinion was his own.

BOWMAN: That's not true, and this shows again, the American people do not trust Elon Musk, and Elon Musk is incompetent in his position. And how do we know? Because they fired tens of thousands of people, it was challenged in court, the court said the people have to go back, and now the people are coming back. He's incompetent, he's a thief, he's a nazi, and people don't trust him.
At the end of my piece, I pointed out that Bowman is not a member of Congress, which means he no longer enjoys broad protection from defamation lawsuits. That meant Musk could sue him if he so chose, and believe it or not, Bowman's accusation of the SpaceX founder being a "thief" is probably more defamatory than the calling him a "nazi."
Bowman seems to have forgotten that he's no longer a congressional member. That means he no longer enjoys the broad exceptions to defamation law that House members enjoy. Given that, Musk should probably consider a lawsuit here. I understand that defamation involving public figures presents a much higher legal bar, but this doesn't stop until someone is made an example of. Bowman seems like the perfect person to fill that role.

His post doesn't make clear if he's also going to sue CNN. I'm not sure Phillip saying, "Your opinion about Elon Musk is your opinion about Elon Musk" went quite far enough to protect the network.

While Philip showed some intent to differentiate, she never actually says Bowman's words do not represent the views of CNN. Of course, I'm no lawyer, and maybe that will be enough, but perhaps the liberal network should think twice before inviting on a deranged, irrelevant lunatic like Bowman. I'll ask the same question I did in my original write-up: What exactly does he offer as far as expertise on politics? Because last I checked, he's best known for pleading guilty to pulling a fire alarm, allegedly to stop a congressional vote.
How successful with Musk be in this case? It'll be tough given the extremely high bar a public figure must meet to prove defamation. Still, it's worth a shot given the pretty obvious malice with which Bowman made his comments. Democrats continuing to go on television and call Republicans "nazis" while falsely accusing them of crimes has become far too common, and none of it stops until someone is made an example of.
