Rep. James Comer announced on Wednesday that FBI Director Christopher Wray has ignored a congressional subpoena for an FD-1023 form that allegedly provides evidence of a bribery scheme involving then-Vice President Joe Biden.
As RedState reported, House Republicans had previously confirmed the existence of the form and moved to subpoena it after the FBI refused to cooperate in Congress’ investigation. Wray has now unilaterally decided that he doesn’t have to obey that subpoena, which would seem to be a problem given others have been prosecuted for ignoring them

As Comer notes, the document is unclassified, therefore any claim of privilege due to national security interests would seem to be mooted. Further, House Republicans are not requesting the identity of the person who made the disclosure and have pledged to protect any whistleblowers who come forward. Still, Wray is refusing to provide it despite seemingly having no legal right to do so.
In response, House Republicans are now set to escalate the situation. Comer explains in the letter that he’s going to try one more time by narrowing and clarifying the scope of the subpoena. If Wray still obstructs, then contempt of Congress proceedings will happen next. Unfortunately, the DOJ is run by AG Merrick Garland, which means there is a zero percent chance that Wray is prosecuted.
