Trump Slams Biden Lawsuit Aiming to Bury Special Counsel Audio

On Tuesday, President Trump, never one to suffer in silence, lashed out at his predecessor, Joe Biden, over the latter's lawsuit to prevent interview tapes of the former president's interviews with his ghostwriter, Mark Zwonitzer. The audio files were obtained by Special Counsel Robert Hur during the Trump classified documents investigation.

President Trump took to his Truth Social platform on Tuesday to label Biden a "crooked politician.

A Fox News report has more details.

President Donald Trump lashed out at former President Joe Biden late Tuesday after his predecessor sued the Justice Department to block the release of audio recordings and transcripts tied to the special counsel investigation into his handling of classified documents.

"A Crooked Politician!!!" Trump wrote on Truth Social while sharing a Just the News article about Biden’s lawsuit against the DOJ.

Biden sued the Justice Department on Tuesday in an effort to block the release of audio recordings and transcripts of the former president’s interview with ghostwriter Mark Zwonitzer that were obtained by special counsel Robert Hur during his classified documents investigation.

This isn't the first legal wrangle the former president (or whoever is handling his affairs) has launched in recent months.

The Biden team's primary argument seems to revolve around these being personal documents:

Biden’s lawyers said in the lawsuit that the Justice Department plans to release the files to Congress and the conservative Heritage Foundation after previously arguing that they were exempt from disclosure under federal public records law.

According to the filing, Biden’s attorneys argued that disclosure would "constitute an unwarranted invasion of President Biden’s privacy."

These files were, however, part of a special counsel investigation.

The Presidential Records Act (44 U.S.C. §§ 2201–2209) defines "personal records" thusly:

(3) The term "personal records" means all documentary materials, or any reasonably segregable portion therof,2 of a purely private or nonpublic character which do not relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President. Such term includes—

(A) diaries, journals, or other personal notes serving as the functional equivalent of a diary or journal which are not prepared or utilized for, or circulated or communicated in the course of, transacting Government business;

(B) materials relating to private political associations, and having no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President; and

(C) materials relating exclusively to the President's own election to the office of the Presidency; and materials directly relating to the election of a particular individual or individuals to Federal, State, or local office, which have no relation to or direct effect upon the carrying out of constitutional, statutory, or other official or ceremonial duties of the President.

These definitions would appear to apply to the interview tapes, and the fact that they were obtained during part of a special counsel investigation doesn't necessarily make them public records as a matter of course. There's an argument to be made that nothing a president does is truly personal, but this is the law as it stands.

Of course, there's the big question: To what extent do these audio tapes reveal Joe Biden's increasingly obvious mental decline throughout his term? There is plenty of evidence about that as it is, not the least of which was his disastrous debate performance against then-candidate Donald Trump in 2024. 

The Biden people have been trying to block any of these records from becoming public ever since he left office in 2025.

Biden has separately fought the release of audio from his interview with Hur. The House in 2024 voted to hold then-Attorney General Merrick Garland in contempt of Congress for refusing to turn over that audio after the White House asserted executive privilege.

Transcripts of Biden’s interviews with federal prosecutors were released last year. While Biden insisted he treated classified information seriously, the transcripts showed he was at times fuzzy about dates and details and said he was unfamiliar with the paper trail for some of the sensitive documents he handled.

It remains to be seen what will come of this latest suit, although the Presidential Records Act would seem to provide a pretty wide umbrella sheltering these documents. But what is of very real concern is the fact that a president of the United States, the man with nuclear weapon release authority, the commander-in-chief of the most powerful military force on the planet, the supposed leader of the free world, was mentally and physically impaired to a degree that is still being unveiled. The Biden people are trying frantically to keep that quiet, but these kinds of things can't be kept under wraps forever.
