Showdown: Florida Attorney General to Defy Judge's Order to Halt Enforcement of Florida Immigration Law

An activist judge has ordered Florida to stop the enforcement of their recent law allowing misdemeanor charges for illegal aliens who enter Florida to evade immigration authorities. This is the showdown; a judge's order is about to be effectively defied by a major state official.

Florida Attorney General James Uthmeier will rebut a judge’s demand that his office order state law enforcement to halt enforcement of a state immigration law she ordered paused under suspicion of unconstitutionality.

The law allows for misdemeanor charges against illegal immigrants who enter Florida and hope to avoid federal immigration officials.

In other words, the Attorney General of the State of Florida, James Uthmeier, is stating that the judge's order will be, for all intents and purposes, ignored.

"The judge wants me to put my stamp of approval on an order prohibiting all state law enforcement from enforcing Florida’s immigration laws when no law enforcement are party to the lawsuit," he said, as the ACLU’s suit is being adjudicated before Obama-appointed Miami federal judge Kathleen Williams.

"I’m just not going to do that. We believe the court has overstepped and lacks jurisdiction there, and I will not tell law enforcement to stop fulfilling their constitutional duties," Uthmeier, who is being threatened with contempt actions, told Fox News Digital.

The legal case will no doubt drag on, but in the meantime, could AG Uthmeier be facing contempt charges?

AG Uthmeier continued:

"I do not believe an AG should be held in contempt for respecting the rule of law and appropriate separation of powers. The ACLU is dead set on obstructing President Donald Trump’s efforts to detain and deport illegals, and we are going to fight back. We will vigorously defend our laws and advance President Trump’s agenda on illegal immigration."

That would seem to imply that the judge may well hold him in contempt.

Think about that for a moment. A federal judge presiding over an ACLU lawsuit has ordered the Attorney General of the State of Florida to cease enforcement of the Florida law that is the source of the suit. The AG, citing his opinion that the judge has no jurisdiction, is defying the order, refusing to order Florida law enforcement to stand down.

And here's the interesting bit: It seems that if the Florida AG is to be brought in to face contempt charges, the person likely to be tasked with bringing him in would be U.S. Marshal Greg Leljedal of the Northern District of Florida. Now, look at this:

They seem to be on remarkably good terms.

President Trump's immigration crackdown, while largely successful, has sparked an unprecedented legal battle. The ACLU is involved, and they seem to have found an agreeable federal judge. Now, a state attorney general has received an order from that judge to stop enforcing a state law that authorizes the action of state law enforcement regarding illegal aliens, and that AG is saying, "No."
