Here we go again.
The never-ending game of a Governor who feels that she has the authority of doing whatever she wants, based on a set of data and science she has yet to provide and a legislature that is just now starting to rise up and say “SLOW DOWN” and deal with us, is once again afoot.
As you may recall back in early October the current Governor of the State of Michigan was told “BAD GUV” by the Michigan State Supreme Court in regards to her executive orders that were found unconstitutional. I wrote about the decision at the time right here…
Gov Whitmer Lashes out at Court Overturning Her COVID Executive Orders. As I summed up the two cases in the article.
In a nutshell, the court said that her orders issued under two different laws were unconstitutional. In specific, since May 1st, she has not issued an executive order in relation to COVID-19 that is legal. This, of course, put a bee in her bonnet, and as those who have watched her Royalness know, she was not going to sit for that.
Well, that did not sit well with the Guv so she is now back with a nifty sidestep of using her Executive Agencies that were used to enforce her illegal orders before and NOW issue the orders themselves. As if she had no say on how these agencies under her control operate. Really is a marvelous take.
From Fox 2 Detroit…
As Michigan faces its toughest test amid COVID-19’s skyrocketing resurgence, Gov. Gretchen Whitmer delivered a return to statewide restrictions more like what residents bore through earlier during the pandemic.
With a more intentional and guided plan for restrictions, indoor gatherings, restaurant operations, in-person learning school, and organized sports will all experience some kind of policy change for the next three weeks.
The laws were enacted by the Michigan Department of Health and Human Services, whose director said it could enforce the new regulations based on what the state legislature passed during the Spanish flu pandemic a century ago.
“We cannot control the fact we’re seeing a surge in cases, we can control how we combat our common enemy,” said Whitmer during a virtual Sunday night press conference held in Lansing.
Beginning Nov. 18 at 12:01 a.m., indoor gatherings will be limited to 10 people, and small outdoor gatherings will be limited to 25 people. The order will last until Dec. 9. Among Michigan’s record-increase in new cases, health officials like Chief Medical Executive Dr. Joneigh Khaldun said crowds of small and medium sizes were among the primary factors driving the spike.
We still do not have any of the data and science that Whitmer and her happy crew of misfits are saying they are basing any of these draconian measures on. This lack of transparency has been going on for eight months and it does not lead to any credibility for these measures. For example, why can gyms stay open but classes of Zumba in those gyms are closed? Also, why are College and High School kids were given a time out from in-class learning but Middle and Elementary school kids are still allowed to go inside the COVID-19 breeding zone of a school?
With no data backing these decisions other than WE SAID SO and now no Federal stimulus package to soften the blow of telling the hospitality industry to go take a long walk off a cold pier with no paycheck, this is a recipe for an economic disaster of biblical proportions. I’m not sorry if people don’t like that phrase but I’m old enough to recall I was told back in March we were going to have close to 2 million people wiped out by now. That was hyperbole also, right?
We are nowhere close to that number and we STILL don’t know how many people were in hospice and caught COVID as they were already dying. We have not had a clear picture of how John Hopkins is tallying the numbers nor do we know locally in a state like Michigan how it is done. The lack of transparency in a ‘pandemic” like this should be incredibly troubling to people that are being told if they live their lives normally that they are breaking the law or even worse, killing people.
Her orders are still executive fiat wishes that the Michigan State Supreme Court has ruled unconstitutional
even though they were issued by her Michigan Department of Health and Human Services. Executive fiats are the same no matter who in the executive branch issues them. If they aren’t passed in the legislature and signed by the Governor, they are not laws.
This overreach might finally be why some in the Michigan legislature are fed up and will consider impeaching her next session which I wrote about right here earlier today. Impeachment of Michigan Governor Gretchen Whitmer Being Discussed in Lansing
At this point, two years into her administration she would probably have better luck consulting a Magic 8 ball for policy decisions and it would be better for Michigan residents. Even if the answer was “Try Again Later” it would be better than what we have now.
