The House is actually out this week (which explains the field hearings). Tuesday's one and only hearing is hosted by the House Oversight and Accountability Subcommittee on Economic Growth, Energy Policy, and Regulatory Affairs in Plano, Texas, regarding “Drilling Down: Oversight of the Challenges and Opportunities Facing U.S. Energy Production.”

Meanwhile, the Senate is set to begin the voting process for the $95 billion Ukraine aid package Tuesday afternoon.

President Joe Biden's Tuesday involves a trek to Tampa, Florida, for two campaign events.

Day 6 of former President Donald Trump's Manhattan criminal trial begins at 11:00 am Eastern on Tuesday. The later start is to afford the court time to hear the prosecution's motion asserting that Trump violated the court's gag order. The trial itself will conclude early again on Tuesday (at 2:00 pm Eastern) due to Passover. 

The Supreme Court will hear oral argument in two additional cases on Tuesday:

Dept. of State v. Munoz — The questions presented are: 

  1. Whether a consular officer's refusal of a visa to a U.S. citizen's noncitizen spouse impinges upon a constitutionally protected interest of the citizen.
  2. Whether, assuming that such a constitutional interest exists, notifying a visa applicant that he was deemed inadmissible under 8 U.S.C. 1182(a)(3)(A)(ii) suffices to provide any process that is due.
  3. Whether, assuming that such a constitutional interest exists and that citing Section1182(a)(3)(A)(ii) is insufficient standing alone, due process requires the government to provide a further factual basis for the visa denial "within a reasonable time," or else forfeit the ability to invoke consular nonreviewability in court.

Starbucks Corp. v. McKinney — To consider whether courts must evaluate the NLRB's requests for section 10(j) injunctions under the traditional, stringent four-factor test for preliminary injunctions or under some other more lenient standard.

Yes, there are still presidential primaries going on. Tuesday, it's Pennsylvania's turn. (The Keystone State is also holding its congressional and statewide primaries for the Auditor, Attorney General, and Treasurer's offices.) 

MORNING MUSING

Fifty-six years ago today (April 23rd), students at Columbia University took over administration buildings and shut down the university in protest of the Vietnam War. That was before my time, so I'm hesitant to weigh in on their justification. Not so as to the current crop of antisemitic cosplayers. Maybe when it's all said and done, we'll reflect and see that their gross antics had a silver lining: exposing the ugly underbelly of academia. Maybe.
