Do Republicans Have a Plan to Stop Democratic Socialist Zohran Mamdani From Being Sworn in If He Wins?

Some House Republicans are reportedly looking into the possibility of invoking a Civil War-era "insurrection clause" to block Democratic Socialist Zohran Mamdani from becoming New York City mayor.

Yes, irony of all ironies, it's the same clause Democrats attempted to weaponize to keep President Trump off the ballot in 2024.

The idea, reportedly the brainstorm of the New York Young Republican Club, is to invoke Section 3 of the 14th Amendment against Mamdani, claiming his anti-ICE stance qualifies him as an insurrectionist.

An obscure part of the Constitution that was resurrected repeatedly by the Democrats in recent years, the "insurrection clause," states that anyone "engaged in insurrection or rebellion" or who has "given aid or comfort to the enemies" of America is ineligible for office.

Rep. Andy Ogles (TN-5) has stated that he is "looking into" utilizing the clause against Mamdani.

Zohran, the radical extremist, currently leads former New York Governor Andrew Cuomo and Curtis Sliwa in polls and seems likely to usher in an incredibly dark era for the city that never sleeps. They may never be able to sleep soundly again if this man becomes mayor.

The New York Post reports that multiple House Republicans are investigating the matter, although it's unclear who is involved and how convinced they are that the plan could work.

“There is a real and legitimate push to see the insurrectionist Zohran Mamdani either a) removed from the ballot or b) removed from office if he is to win on Tuesday,” Stefano Forte, president of the New York Young Republicans, told the outlet.

The ploy is another sign that Republicans are desperately seeking a solution to save New York City from its own destruction by installing Mamdani, who some view as a full-blown communist, as their mayor.

It faces several hurdles. One, it would have to get through a slim Republican majority in the House, where one could easily see defectors not keen on voting in favor of something the Democrats tried to use to prevent Trump from running for office. It would also need to garner 60 votes in the Senate, where the opposition party is currently unable to get behind the seemingly simple concept of reopening the federal government, let alone a wild-card attempt to prevent someone their voters have backed from being sworn in.

Then there would be the numerous legal challenges that would no doubt ensue. The Supreme Court, amid state efforts to keep Trump off the ballot in 2024, ruled that only Congress could make such a decision.

"Responsibility for enforcing Section 3 against federal officeholders and candidates rests with Congress and not the States," they said in a unanimous decision.

This would be a significant test of that decision.

So why pursue such a huge long shot? Having to vote on the matter would likely force some Democrats, who had been heretofore reluctant to voice support for Mamdani, to do so on the record. This would play right into the hands of Republicans and a White House that would point to the Democratic Socialist as the face of the party heading into the midterms.

In the meantime, though, President Trump, who has long had ties to the city, has pulled out all the stops in trying to prevent Mamdani from winning on Tuesday, including making it clear that he would seek to cut off funding to NYC and even backing the dreadful alternative in Cuomo.

"If Communist Candidate Zohran Mamdani wins the Election for Mayor of New York City, it is highly unlikely that I will be contributing Federal Funds, other than the very minimum as required, to my beloved first home, because of the fact that, as a Communist, this once great City has zero chance of success, or even survival!" Trump wrote on Truth Social.

"Whether you personally like Andrew Cuomo or not, you really have no choice. You must vote for him, and hope he does a fantastic job," the president added. "He is capable of it, Mamdani is not!"

They'll both contribute to the decay of New York City. But Mamdani will accelerate that decay exponentially. Which is why nearly one million residents have already indicated they would "definitely" flee the city if he wins.

There seems to be no viable solution to averting this looming disaster. This plan to invoke the "insurrection clause" is unlikely to succeed either.
