America First Victory? Proposed New Amendment Bars Foreign-Born From Power

There's one way to slam the door on a political issue in the United States: Pass and ratify an amendment to the Constitution. That, once an amendment is ratified, makes whatever was proposed part of the highest law in the land. They can be repealed; the 18th Amendment, which made Prohibition part of the Constitution, was repealed by the 21st Amendment. But they can't be overturned by a court. Any court. If, say, a constitutional amendment were ratified stating that, henceforth, anyone elected to the Senate or the House of Representatives, or anyone appointed to high office, must be a natural-born citizen, as any candidate for president must be now, then that would be pretty final.

Interestingly, Republican Representative Nancy Mace (SC-01) has introduced a resolution to begin the process to do just that. Rep. Mace announced the move on her official X account.

Rep. Mace writes:

ICYMI: We introduced a joint resolution proposing a constitutional amendment REQUIRING Representatives, Senators, federal judges at every level, and all Senate-confirmed officers to be natural born citizens.

This is not complicated. If you hold power in the American government, you should be a natural born American citizen.

Several foreign born lawmakers currently holding power in this government have made clear their loyalties do not lie with the American people. Ilhan Omar is a prime example of why this amendment is necessary. 

The American people deserve leaders who put America first. This amendment makes sure of it.

On Thursday, Fox News released excerpts from a statement by Rep. Mace, who is at the moment running for governor of South Carolina. Rep. Mace, in advocating for her proposal, wasn't shy about naming names.

"If you hold power in the American government, you should be a natural-born American citizen," Mace told Fox News Digital in a statement. "For too long we have allowed foreign-born members to hold seats in this government, while making clear their loyalty is not here. We see it every day."

Mace specifically called out progressive Rep. Ilhan Omar, D-Minn., who was born in Somalia and became a naturalized citizen in 2000.

"Ilhan Omar is just one of many foreign-born members of this government who have made clear, time and again, their loyalty is not here," Mace said. "The American people deserve leaders who put America first. This amendment closes a gap in our Constitution long overdue for closing."

There are a couple of things to consider about this proposal.

First, sadly, it's unlikely in the extreme that this idea will grow any legs. The Constitutional amendment process was made difficult on purpose, to prevent capricious amendments (although, yes, the 18th Amendment ended up being a bad idea on stilts, and for that matter, don't get me started on the 16th or 17th amendments.) But this seems unlikely to even get out of the House or the Representatives; for one thing, Democrats would be lock-step against it, and it seems likely a fair number of Republicans would look askance at this proposal.

Second: The above doesn't mean it's a bad idea. The Founders put the natural-born requirement in for president and vice president, but they likely didn't foresee a day when the United States was dealing with massive Third World immigration, legal and illegal, from low-trust and no-trust societies - like Somalia. 

Chalk this up as another fair idea that probably won't go anywhere. But then, the world's got no shortage of windmills to tilt at.
