Trump's Overhaul of Immigration May Extend to Revoking Citizenship for Bad Behavior

The Trump administration is planning to start stripping citizenship from naturalized citizens who are determined to be offering material support to Hamas and other such groups. Administration adviser and head of the Article III Project, Mike Davis, said, "What's going to be on the horizon are denaturalization cases. You're going to have Hamas supporters who have been naturalized within the last 10 years, and they are eligible to lose their status as citizens and get deported."

That would be cutting our losses when we made a poor decision in granting citizenship to an immigrant.

Many people think citizenship is a done deal once it is granted. It isn't. Citizenship may be revoked for several reasons.

  • for having “illegally procured” citizenship or by “concealment of a material fact or by willful misrepresentation.”   
  • for a conviction for procuring or attempting to procure the naturalization of anyone contrary to the law.  
  • for being discharged under other than honorable conditions if they acquired naturalization through wartime military service,
  • or refusing to testify before a congressional committee on alleged subversive activities. 

Any lie or misrepresentation on a citizenship application opens the door to having citizenship revoked. The ability to denaturalize someone for illegally procuring citizenship extends back quite a distance. In 2004, Jakiw Palij was denaturalized for having been a Nazi concentration camp guard during World War II and not disclosing it when he became a citizen in 1957.

In addition to the above causes, 8 USC §1451 allows for denaturalization for membership in organizations that show "such person was not attached to the principles of the Constitution of the United States and was not well disposed to the good order and happiness of the United States at the time of naturalization." This proviso stopped Communists during the Cold War...and should stop them and Islamists today.

Citizenship in the United States is something to be treasured. Unfortunately, a lot of natural-born citizens on the left and the right no longer see it that way. We can't do much about that. What we can do is ensure that the people we admit into the country are loyal and they support the ideals that made America the place that attracted them. If we make a mistake, we need to rectify that.
