BREAKING: House Votes to Impeach DHS Secretary Alejandro Mayorkas

It appears the second time was the charm insofar as it relates to the impeachment of Department of Homeland Security Secretary Alejandro Mayorkas. In a close 214-213 vote Tuesday evening, the House of Representatives voted to impeach the embattled cabinet secretary, marking the first such impeachment in nearly 150 years.

The Articles of Impeachment against Mayorkas were unveiled in late January.

The articles listed include: 

  1. Willful and systemic refusal to comply with the law
  2. Breach of the public trust 

The articles, consisting of 20 pages, lay out a detailed basis for the impeachment:

"Throughout his tenure as Secretary of Homeland Security, Alejandro N. Mayorkas has repeatedly violated laws enacted by Congress regarding immigration and border security. In large part because of his unlawful conduct, millions of aliens have illegally entered the United States on an annual basis with many unlawfully remaining in the United States. His refusal to obey the law is not only an offense against the separation of powers in the Constitution of the United States, it also threatens our national security," Republicans allege in the first article.

"Alejandro N. Mayorkas knowingly made false statements to Congress that the border is 'secure,' that the border is ‘no less secure than it was previously,’ that the border is 'closed,' and that DHS has ‘operational control’ of the border," they allege in the second article.

The close vote came exactly one week after a failed impeachment attempt. In last Tuesday's vote, the nays bested the yeas 216 to 214 after the Democrats wheeled Rep. Al Green (D-TX) in a surprise move. House Majority Leader Steve Scalise (R-LA) was out for medical reasons last week, which left the Republicans one vote short. With three Republicans — Tom McClintock (CA), Ken Buck (CO), and Mike Gallagher (WI) — voting nay initially, Utah Rep. Blake Moore switched his vote to a "nay" to preserve the procedural option to bring up a second vote.

With Scalise back, the Republicans had the numbers to pass the resolution Tuesday evening.
