Marc Elias and the DCCC Hit With FEC Complaint Over Alleged Misclassified Payments

Last Wednesday, we brought you the news that Democrat “super lawyer” Marc Elias was parting ways with the Democratic National Committee (DNC) — or vice-versa. As Sister Toldjah reported:

In the eyes of conservatives, Elias is undoubtedly one of the biggest Democrat hypocrites to ever walk the face of the Earth (and with the massive ego to match) who purports to be morally opposed to partisan gerrymandering except in all the instances where he’s not.

Most infamously, Elias funded (and then initially lied about his role in) the discredited/debunked Steele dossier that alleged then-GOP candidate for president Donald Trump colluded with Russia to steal the 2016 election.

Considering the decades of service he’s put in for Democrats at the expense of election integrity and the rule of law, it was rather intriguing to find out from Punchbowl News Wednesday morning that the DNC has decided that they will no longer retain his services:

The DNC and Elias had a number of strategic disagreements, according to sources familiar with the internal deliberations.

Elias has represented the DNC since 2009. His firm, the Elias Law Group, represents all of the major Democratic entities in Washington. Elias will continue to work for the DCCC, DSCC, DAGA and DLCC. And Elias counts a slew of senators and members as clients.

Most notably, Elias, a former partner at Perkins Coie, has been behind what he calls the “Democracy Docket” — an array of voting rights challenges nationwide. On Tuesday, Elias said this covered 45 cases in 18 states. And Elias has a knack for winning these cases, raising the ire of Republicans.

Elias’ firm has pulled in roughly $100,000 this year already from the DNC, according to FEC filings. In the 2022 cycle, the DNC paid Elias’ firm just shy of $2 million, according to campaign reports.

Flash forward to this Wednesday, and what do we learn?

Oh. Now, in fairness, I need to point out this is only a complaint — not an adjudication — and it’s being brought by an anti-Biden super PAC. Nevertheless:

The Elias Law Group was paid nearly $5.2 million by the DCCC from Oct. 2021 to July 2022 for legal services classified as “RECOUNT LEGAL SVCS,” despite no federal recounts taking place in that time period, and months to go until the Nov. 2022 midterm elections, according to an FEC complaint brought on April 10 by the Committee to Defeat the President, an anti-Biden Super PAC.

But wait — there’s more!

After July 2022, Elias’ group received an additional $7.3 million for recount-related services for the midterm elections, the complaint alleges. Elias’ firm was tasked with preparing for potential recounts, monitoring the conduct of the election and handling post-election disputes.

In addition to the “recount” payments, the DCCC also paid Elias Law Group over $1 million for “legal services rendered” and “headquarters legal services” from 2021 to 2022 and reported the payments as “other federal operating expenditures.”

The 18-page complaint was acknowledged by the FEC in this April 17th letter. The complaint references Elias’ previous lack of candor regarding and sanctions for such, noting:

Such fraudulent representations are particularly likely to have occurred since the Elias Law Group’s name partner, Marc Elias, has a history of lack of candor and has been sanctioned for such conduct by a federal Court of Appeals. See Order, Texas Alliance for Retired Ams. v. Hughs, No. 20-40643 (5th Cir. Mar. 11, 2021). Moreover, the FEC recently executed conciliation agreements concerning another Democratic national party committee’s materially false descriptions of Elias’ services to hide from public scrutiny his role in compiling the salacious, false Steele Dossier, which Democratic operatives used to attempt to steal the 2016 election. It will certainly be interesting to see what comes of this latest complaint. In the meantime, Elias’ relationship with the DCCC and other Democratic entities, like the DSCC, DAGA, and DLCC continues. At least for now.
