More Trouble for Fani Willis as Judge Unseals Divorce Proceedings, Weighs in on Her Deposition

We had a lot of bad news for Fulton County DA Fani Willis that we reported on over the weekend. Willis has been alleged to be in a romantic relationship with the special prosecutor Nathan Wade, whom Willis appointed in the election interference case against former President Donald Trump.

Jocelyn Wade -- the wife of the special prosecutor -- dropped devastating evidence on Friday - receipts for trips Willis and Wade allegedly took together to multiple places. Fulton County Commissioner Bob Ellis demanded answers from Willis asking about whether county funds were "misused."

But now there's more bad news for her in relation to the divorce case. 

The judge ordered the divorce proceedings unsealed, so even more information may be coming out about the alleged affair. That isn't going to make Willis happy. Jocelyn Wade was trying to depose Willis in the case and the deposition had been scheduled for Tuesday. Willis was fighting that, saying she shouldn't have to do it at all. While Judge Henry Thompson did delay the deposition for Willis, he didn't decide in her favor, saying he wanted to hear from Nathan Wade first and then would determine if Willis had additional information that might be needed.

Fox interviewed Georgia State University Law professor Clark Cunningham, who said her staying on the case was problematic. "If the case hasn't gone off the rails already, it's about to," he said, saying he didn't see "anything good from her staying in charge of the case."

Things weren't going well for Willis after Wade's estranged wife dropped damaging information:

A lawyer for Joycelyn Wade wrote in court papers filed Friday that Nathan Wade has taken trips to San Francisco and Napa Valley, Florida, Belize, Panama and Australia and has taken Caribbean cruises since filing for divorce and that Willis “was an intended travel partner for at least some of these trips as indicated by flights he purchased for her to accompany him.”

The filing includes credit card statements that show Nathan Wade — after he had been hired as special prosecutor — bought plane tickets in October 2022 for him and Willis to travel to Miami and bought tickets in April to San Francisco in their names.

Michael Roman, a defendant in the Trump case who raised the issue of the alleged affair, had asked the case be dismissed against him and that Willis, Wade and the Fulton County DA be blocked from further involvement. The judge in that case set a hearing for Feb. 15 and ordered Willis to respond to those allegations in writing by Feb 2.
