Trump Turns SCOTUS Lemons Into Lemonade: 'Too Bad' on Birthright, but Massive Wins Elsewhere

The Supreme Court set the world on fire with a series of rulings Monday and Tuesday that will have profound consequences for the country. As usual when the High Court hands down multiple decisions, some cases infuriate the Right, while others make the Left apoplectic.

We’ve seen positive rulings on executive power, men in women’s sports (how about, no), campaign spending, and perplexing decisions on mail-in ballots (incredibly, SCOTUS ruled they don’t have to arrive by Election Day), and, most controversially, knocking down President Trump’s executive order ending automatic birthright citizenship.

As we reported, Trump was upbeat about the decisions earlier Tuesday, but many expected him to go nuclear over the birthright citizenship case, Trump v. Barbara.

He took the defeat in stride Tuesday afternoon and said in an unusually muted tone for him that it was “too bad for our country.” Instead of moping, he immediately turned to finding other ways to accomplish the goal of ending the “expensive and unfair” system:

Supreme Court Upholds Birthright Citizenship, Strikes Down Trump Executive Order in 5-4 Vote


The president noted that while the birthright citizenship case was a defeat, he actually considers the Slaughter decision — which held that the Federal Trade Commission's (FTC) statutory "for-cause" removal protections for its commissioners violate Article II and significantly expanded presidential removal authority — to be much more important:

The biggest and most consequential Decision issued by the Court, by far, is the Slaughter Case, which overturned the very famous Humphrey’s Executor Rule. This whole concept of “Power” has been fought over for nearly 100 years, going all the way back to Franklin Delanor Roosevelt, where a large slice of his Power was taken away. He fought to regain it, even wanting to “pack the Court,” but was unsuccessful in doing so. This Decision gives tremendous additional Power back to the Presidency, where it belongs. It is an Honor to be the sitting President who, after all these years, WON this very important, and hard fought, Case. We had other good Victories, too, and we also had the Birthright Citizenship loss, which we will work to correct in Congress, but the big SLAUGHTER, was SLAUGHTER. The Republican Party was treated very fairly by the United States Supreme Court. Thank you for your attention to this matter! President DONALD J. TRUMP

RedState’s Susie Moore explains that “Humphrey’s Executor” goes all the way back to the 1930s:

The ruling upholds the Trump administration's position and effectively overrules what remained of Humphrey's Executor, the 1935 case in which SCOTUS held that the removal statute only permitted the president to fire FTC commissioners “for inefficiency, neglect of duty, or malfeasance in office.”

Kurt Schlichter over at our sister site Townhall also wasn’t fazed, writing in his article Cheer Up! The Birthright Citizenship Case Moves Us Toward Inevitable Victory, that it’s but a bump on the road:

Calm down about today’s birthright citizenship case, Trump v. Barbara. We were always going to lose. That was expected by anyone who understands how the courts work; what wasn’t expected is that this ruling was such a huge step toward eventual victory. You don’t have to be happy, but you don’t have to freak out. We’re winning.

Many legal observers expected that the Court would strike down Trump’s EO, so it’s not some stunning surprise out of nowhere.

As Trump noted, the mail-in ballot and birthright citizenship decisions are unfortunate, but come nowhere near to outweighing the good that will come from the judgments on men in women’s sports, Slaughter, and campaign financing.

“The Republican Party was treated very fairly by the United States Supreme Court,” the president wrote in the above social media post. Not everyone will agree with that assessment, of course, considering the birthright decision setback and the silly mail-in ballot vote. Overall, though, one can certainly argue that the recent spate of decisions came in largely in the GOP’s favor.
