We’ve seen so much anti-American sentiment from the Left as we approach our 250th birthday that it’s hard to be shocked anymore. The Marxists have had trouble coping with the fact that the U.S. is hosting a wildly successful World Cup, our men’s national team has performed well so far, and Europeans visiting are absolutely wowed by the friendliness and awesomeness of our fruited plains.
As our Becky Noble reported earlier Tuesday, a San Marcos, California homeowner’s association is telling residents to take down their American flags or face fines. Losers. Meanwhile, on the opposite coast, Karens are telling people on Plum Island, off the northeastern coast of Massachusetts, to take theirs down as well.
Why? Because flags might annoy seabirds. Seriously.
The Town of Newbury sent a letter to Plum Island, which it has jurisdiction over, and warns of serious consequences should folks celebrate our country:
The letter warns "activities intended to deter protected shorebirds from utilizing suitable habitat may be viewed as harassment or disruption of normal feeding, nesting, or migratory behavior," which violates the federal Endangered Species Act, and "carry significant regulatory and financial penalties."
"Non-compliance may result in state or federal enforcement actions and, thus, the Town urges residents to comply with applicable state and federal wildlife protection laws," the notice further read.

Pacific Legal Foundation (PLF), a nonprofit law firm that focuses on individual liberty, property rights, limited government, and separation of powers, is fighting for one of Plum Island’s long-term residents, Marc Sarkady. They responded to the town’s unpatriotic letter with a missive of their own:

The letter demands to know, what exact legal basis are you using to justify your threats?
The letter raises significant concerns regarding both private property rights and the legal authority upon which the Town relies. Most notably, the Town appears to suggest that homeowners may face potential state or federal liability for displaying ordinary decorations or engaging in customary uses of their own property if those activities allegedly discourage protected birds from utilizing nearby habitat. Yet the letter identifies no statute, regulation, judicial decision, or agency guidance establishing that proposition.
The town has backtracked following their aggressive communication following outrage. Newbury Town Administrator Tracy Blais tried to pretend the whole thing never happened:
"The letter merely recited provisions of the law, and the Town is not asserting any threat or legal liability — merely reminding property owners that they live in a very special place which comes along with certain responsibilities. The Town is not asserting any rights or control it does not have, and I think the Town's letter is pretty clear on that point."
Yea, well I thought that the letter was pretty clear that you wanted to play little dictator.
Tom Shattuck, editor-in-chief of the investigative site The Maine Wire, says he went to the Town of Newbury and witnessed plenty of American flags still flying in the breeze. Did they ban Pride flags during Pride Month? he wanted to know.
