Milwaukee Judge Hannah Dugan is the genius who thought it would be a good idea to hide an illegal alien in her courthouse and help him escape through a side door when ICE agents came to nab him. It turned out to be a spectacularly bad plan as first the Wisconsin Supreme Court suspended her in late April, and then on Tuesday, a federal grand jury indicted her on two charges. She's facing up to six years in prison and a maximum fine of $350,000.
Now the judge is arguing for the case to be tossed out, and her basic argument is that she is above the law:
"The problems with this prosecution are legion, but most immediately, the government cannot prosecute Judge Dugan because she is entitled to judicial immunity for her official acts," her attorneys argued in the motion.
Ah, the old “judicial immunity” argument. (Actually, it’s not old to me; I’ve never had the cause to write about it.) Now, I’m not a lawyer, but it’s hard for me to see how breaking the law is an “official act.” I’ll let actual lawyers bring the analysis, though, and as Townhall columnist and "Inside the Law" host Phil Holloway writes, “[it] is not an official judicial act. Who wants to tell her?”

George Washington University Law School professor and frequent pundit on all things legal Jonathan Turley was also less than impressed:
...I can't see any basis to do that [dismiss these charges].
You can certainly disagree with her motivations, but that's not something that a judge can just assume without a trial. So my assumption is that the motion to dismiss today will be indeed turned down by the court.

This woke judge was caught red-handed and is now in a world of hurt of her own making. Or at least, that’s the way it should be—but as we’ve seen across the country in recent months, activist judges have gone to staggering lengths to bend the law in ways that fit their ideologies. It’s certainly possible that in the swing state of Wisconsin, some extremist judge might go to any lengths to justify throwing it out.
In fact, Dugan’s case has been assigned to U.S. District Judge Lynn Adelman, and some pundits are not impressed with the 85-year-old Clinton appointee.

It would be nice to see some actual justice in this case; we’ll just have to wait and see. Unfortunately, there's also the chance that Dugan with her magical “judicial immunity” could get off scot-free—as ludicrous as that would be.
