DOJ Scores Coup With First-of-Its-Kind Settlement on Ending 'Gender-Affirming Care' for Kids

The Justice Department (DOJ) announced that it has scored something of a coup in the ongoing fight against medical facilities and physicians who practice "so-called transgender care" on minors, with a new settlement agreeement on Friday.

But the news on this issue gets even better. More on that in a minute. 

In a press release Friday, the DOJ said that Texas Children's Hospital (TCH) has signed on to a series of "agreements" ending its surguical procedures on kids, and making amends to the victims of all forms of medical transitioning:

Today, the Department of Justice announced the first resolution secured under the Department’s ongoing national investigation into violations of federal law in connection with the provision of sex-rejecting procedures on minors (often euphemistically called “gender-affirming care”).  

Texas Children’s Hospital (TCH) has entered into agreements with the Department and the Texas Attorney General that include commitments to not perform such procedures on children, which include the administration of puberty blockers and cross-sex hormones.  

As the statement notes, the settlement was reached with coordination of Texas AG Ken Paxton's office. It continued with details on the painful financial pinch Texas Children's will suffer due to their actions. This is where it gets better, as the facility must help "detransitioners" in a new center outlined in the agreement:

TCH has also agreed to collectively pay over $10 million in damages and civil penalties and to dedicate millions to the provision of medical care to children harmed by the provision of such procedures (i.e., “detransitioners”).

Unfortunately, the next month, the American Medical Association spoke erratically on the issue - after previously doing an about-face on its stance supporting transgender care.

Here's more of the granular info, and the DOJ's allegations that lead the settlement. The Justice Department also hails the hospital for "cooperat[ing]" with investigators throughout the process:

Under the terms of the agreements, which the Department of Justice reached in coordination with Texas Attorney General Ken Paxton, TCH will pay $10 million to resolve allegations that it submitted false billings to public and private payors to secure insurance coverage for pediatric sex-rejecting procedures.  The Department alleges this conduct violated the Federal Food, Drug, and Cosmetic Act, the False Claims Act, and federal fraud and conspiracy laws.  Critically, in addition to terminating these services, TCH has committed to establishing the first-of-its-kind clinic dedicated to restorative care for detransitioners.

In connection with the settlements, the United States acknowledged that TCH took significant steps entitling it to credit for cooperation with the Department in its investigation.  At all times during the investigation, TCH remained cooperative, proactive, and solution-driven, as highlighted by its multi-million-dollar commitment to providing care to the victims who most need it.

In a statement, Acting AG Todd Blanche said:

“The Justice Department will use every weapon at its disposal to end the destructive and discredited practice of so-called ‘gender-affirming care’ for children.

“Today’s resolution protects vulnerable children, holds providers accountable, and ensures those harmed receive the care they need.”

Assistant AG Brett Shumate, whose Civil Division's Enforcement and Affirmative Litigation Branch is leading the fight to dismantle the so-called "transgender care" practices on children, while partnering with the Commercial Litigation Branch, Fraud Section, celebrated the agreement as a big victory for victims. He wrote on X:
