Trump Organization Hails Appeals Court Ruling Halting NY Judge's Order Dissolving Trump Companies

On Thursday, RedState reported on the latest shoe to drop in the civil fraud case brought by New York Attorney General Letitia James against former President Donald Trump, as the NY judge in the case, Arthur Engoron, tacked on an order to a prior motion on the Trump business assets, which was set to dissolve the companies Trump's family runs, including the Trump Organization.

The order, which also "applie[d] to Donald Trump Jr., Eric Trump, former chief financial officer of the Trump Organization, Allen Weisselberg, and Trump Organization controller Jeffrey McConney," prohibited them from transferring any of the businesses' assets without signing off with a court monitor:

Engoron's supplemental order states that Trump and the other defendants must disclose all of the entities they own and declare in advance "any anticipated transfer of assets or liabilities to any other entities."

A New York court ruled Tuesday that former president Donald Trump had committed fraud for years to build his fortune. New York Judge Arthur Engoron, ruling in a civil case brought by New York Attorney General Letitia James, found that Trump and his company defrauded insurers, banks, and other business partners by massively overstating the value of his assets and net worth. Trump, Engoron ruled, had gone far beyond mere puffery and used fake values to get lower loan and insurance rates.[...]

He also revoked the business licenses of some of Trump's companies and ordered a receiver appointed to oversee the dissolution of those companies. Among those companies is Trump's flagship Trump Organization.

Now in the latest update, on Friday an appeals court provided a partial win for Team Trump, placing a hold on Judge Engoron's order to "cancel the business certificates" of the companies while refusing to stay the trial itself::

A New York appeals court on Friday refused to stay the ongoing civil business fraud trial of Donald Trump and his company, but did halt a judge’s order to cancel the business certificates of Trump’s companies in the state.

The ruling came after Trump’s business fraud trial ended its first week of proceedings in Manhattan Supreme Court. [...]

Friday’s ruling staying the cancellations but allowing the trial to resume came from a justice in the appellate division that handles case arising out of Manhattan Supreme Court.

AG James, whose office did not argue against the Trump attorneys' appeal of the business ruling, didn't comment on the reversal. Meanwhile, Trump attorney Christopher Kise team put out a statement declaring victory:

We are very pleased the First Department upheld New York law and put a halt to any cancellation of business certificates, receivers or dissolution. The trial court’s attempt to reach issues, entities and assets beyond the scope of this case has been suspended.

But that wasn't the only reaction from the Trump side of the ledger. The Trump Organization released a statement, which was shared on social media by Today News Africa's chief White House correspondent, Simon Ateba:

His post on X reads:

BREAKING: Trump Organization happy, issues statement after Appeals Court win halting the process of breaking up Donald Trump's businesses in New York. [...]

"We thank the Appellate Division for staying the NY Attorney General’s and Judge Engoron’s overzealous attempt to cancel our New York business certificates.   

Judge Engoron’s order erroneously sought to adjudicate the rights of non-party business entities that employ nearly 1,000 hard-working New Yorkers, have never been accused of any wrongdoing and were never given their day in court – in clear violation of their fundamental Constitutional rights and Due Process. 

We will continue to vigorously defend our company and our incredible employees from this gross overreach and politically-motivated persecution."

Ateba added after the statement that it was "Associate Justice Peter Moulton [who] issued the ruling after a brief hearing Friday afternoon."
