Impeachment Trial: Mark Levin Nailed It

There are only a very few people worthy of your trust in the media these days. One of them is Mark Levin, who hosts his “Life, Liberty and Levin” show on Fox News Channel on Saturday nights. Levin is a lawyer and a former president of the Landmark Legal Foundation, a conservative non-profit organization that advocated limited government policies, as well as the author of seven books. A lifetime student of the Constitution and constitutional law, he wrote a book entitled, The Liberty Amendments: Restoring the American Republic, that recommended eleven new Constitutional amendments to restore the liberties and freedoms that have been eroded by the Left over the past 100 years.

Last Saturday, Levin outlined his view of the Senate impeachment trial and described exactly what it was all about. As you read his commentary, look back at what you observed during the trial. It was a political farce, and Levin called it perfectly.

I feel compelled to address what’s been going on in the floor of the US Senate. It’s supposed to be a somber occasion. There’s nothing somber about it; it’s a farce, pathetic, it’s grotesque. The senators have a job to uphold the Constitution of the United States and to protect it – not from a law-abiding president, but from a lawless majority in the House of Representatives, the Democrats.

You don’t need three days and 24 hours if you have a true case for impeachment against a president, a vice president, or a judge and so forth. They’re all over the map. They’ve got their graphs and their video clips and their repetition and their emotion, and they’re attacking the President, and they’re attacking the senators, they’re undermining judicial review in the courts. It is an embarrassment.

The very chairmen of these two committees, the House Intelligent Committee and the House Judiciary Committee, who ran Stalinist-like hearings … violated their own committee rules, violated the House rules, violated basic due process … I’m not talking about the Bill of Rights, but the due process that is customarily and traditionally been afforded a president facing a situation like this, or a judge facing impeachment … it was completely eviscerated.

And then we have the czarina, that is, the Speaker of the House. She didn’t have a vote to open an impeachment inquiry; she declared it. Like Eva Peron – “we’re having an impeachment inquiry.” None of the rules that were in place in the past – when Henry Hyde, a Republican ran the Judiciary Committee [during the Clinton impeachment], and the Republicans ran the House of Representatives – have been applied. When Peter Rodino ran the House Judiciary Committee and the Democrats controlled the House when they were looking at Nixon for impeachment, all those rules were thrown out the window. All due process thrown out the window. All the House rules thrown out the window.

And as you know, Republicans couldn’t call witnesses. The President’s lawyer wasn’t present for those secret star chamber testimony events taking place in the basement of the House of Representatives. It’s appalling. I mean, the real story here is Donald Trump is being treated like no president in American history. In fact, like no person facing impeachment in American history! That’s a fact. The corruption, the abuse of power – if you will, has taken place already in the House of Representatives.

And so every Republican in the House votes against this. Every single one! Every Democrat but one voted for it. That should tell you everything you need to know. So that’s their case. These articles of impeachment, which are phony – abuse of power, obstruction of Congress – absolutely phony. Let’s look at what the requirements are in the Constitution of the United States:

From the National Constitution Center: “The Final section of Article II, which generally describes the executive branch, specifies that the ‘President, Vice President and all civil Officers of the United States’ shall be removed from office if convicted in an impeachment trial of ‘Treason, Bribery, or other high Crimes and Misdemeanors.’ Two clauses in Article I lay out the role of the House of Representatives and te Senate in impeachments and in trials of impeachment. In practice, impeachments by the House have been rare, and convictions after a trial by the Senate even less common. Two Presidents, one Senator, one cabinet officer, and fifteen judges have been impeached, and of those only eight judges have been convicted and removed from office.”

So you better have a strong case, boy; it better be an overwhelming case. But, [the House managers say] “we need 24 hours and three days. We need John Bolton; he’ll make the case. If not him, Mulvaney will make the case. … The senators better do what we say, otherwise they’re involved in a cover-up, and they’re obstructing, and they’re not holding up their constitutional duty.’

Well, I’ll tell you what they have. They have zippo. Nothing! I have right here the telephone call that we go back to – the transcript of the President of the United States call on July 25, 2019 with the President of Ukraine. Tell me, where in here is there treason, bribery, or other high crimes and misdemeanors?  There aren’t any. There are none – zero – which is why they almost never refer to them.

Now what about regular crimes that are out there – which of course you don’t have to have for impeachment, but it would be nice if they had something. What did the President do? Did he say, “Look, President of Ukraine, I want you to get me dirt on the Bidens”? He never said that. Or, “I’ll withhold military aid”? Never came up. Or, “I want you to announce that you’re going to do an investigation.” That’s not what he said. He said none of those things. So they have to spend 24 hours and three days putting words in the President’s mouth that he never spoke. Putting words in the mouths of other people.

Now, they did have some witnesses over there in the House Intelligence Committee. But the House Judiciary Committee? Not really. A couple of law professors, a couple of lawyers who served on the House Intelligence Committee. That was the extent of their investigation. But let’s take a look. Let’s look at what the individuals who Adam Schiff and Nancy Pelosi and the Democrats … by the way, almost all of them are hearsay witnesses – firsthand witnesses to nothing … but what did they have to say about impeachment and high crimes and all the rest of it? (played a string of video clips showing the House witnesses denying a quid pro quo or any impeachable acts by the President) You won’t see any of that video on the House managers’ side [as they present their case].

I don’t need 24 hours; I don’t need three days. Case closed. What are these other witnesses gonna tell them? The president of Ukraine says, “I wasn’t pressured.” We heard – on and on they’re droning on – there was a pressure campaign … the CIA sitting on documents … the NSA sitting on … they had all these documents we can’t get our hands on. Where’s the smoking gun document that the President committed an impeachable offense? Where is it? It doesn’t exist. Where’s the killer witness, the first-hand witness in the House of Representatives? He or she doesn’t exist. There’s nothing. That’s why it takes 24 hours and three days cobbling things together like the demagogues and propagandists [that they are].

But let’s be honest about what’s really going on here. We were told about this November 17, 2016. In the NY Times, “Trump’s foreign business ties may violate the Constitution.” The emoluments clause. “President Donald Trump’s business dealings have raised concerns about ethical considerations.” And they go on about how that may impact is ability to serve as president. December 15, 2016, in Vanity Fair: “Democrats are paving the way to impeach Donald Trump.” On Inauguration Day, January 20, 2017, in the Washington Post was this headline: “The campaign to impeach President Trump has begun.” That’s why they need 24 hours and 3 days – because their hands, their DNA is all over their crooked and corrupt practices. That’s why, and it’s absolutely outrageous – it has been an impeachment campaign from the very beginning!

Look, we’ve got all kinds of witnesses (say the Democrats). In fact, they need to go to Craigslist – hey, anybody out there who can tell us on the floor of the United States Senate – tell us that the President of the United States violated the Constitution … treason, bribery, or other high crimes and misdemeanors … anything … we need something. ….

Every damn thing they’ve said about this president is a lie.

Levin nailed it: a political farce. House Democrats violating House rules, due process, and long-standing traditions. Nothing but a hearsay case disproven by their own witnesses on cross-examination. The call transcript that destroyed the House Democrats’ case. The Democrats’ impeachment campaign that began the day after the President was elected in 2016. The media frenzy to push false allegations that would lead to his impeachment. And then two articles of impeachment passed in the House that don’t pass constitutional muster. Three days and 24 hours to present a hearsay case, cast aspersions, read the President’s mind, decipher his public statements to determine intentions, and weave a web of lies.

And that’s exactly what we saw during the Senate impeachment trial, wasn’t it? Mark Levin is one of the few talking heads who can be trusted to tell it like it is.
