The Supreme Court handed President Trump a signal victory over a federal judge who has become Trump's nemesis and a darling of the anti-Trump left. In a 5-4 decision with Justices Sotomayor, Kagan, Jackson dissenting and Justice Barrett dissenting in part, the Supreme Court ruled that President Trump could use the Alien Enemies Act to remove Venezuelan gang members, vacated all orders by the self-important Judge James Boasberg, and, as if to signal it didn't want to hear any more about this case from this judge, it said "venue is improper in the District of Columbia."
On March 15, President Trump signed an executive order titled Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua – The White House. In this order, President Trump announced he would use the 1798 vintage Alien Enemies Act to deport some of the Venezuelan criminals who had accompanied the illegal migrant stream into the US under the Biden administration. As an aside, it was a hoot to see anti-Trumpers of all stripes get agitated over the AEA being signed into law by John Adams while seeming to forget that our Bill of Rights was ratified in 1791. From that point, the issue has been dominated by a battle between the US Department of Justice and a vindictive and bullying Judge Boasberg who was miffed when the administration lawyers didn't turn an airplane around in mid-flight and bring back to the US a plane load of Venezuelan gangsters. It gave a stamp of approval to the AEA as a tool for removing some illegals and established some guardrails for future removals. Illegals contesting their removal must use habeas corpus at the place they are held pending deportation, which would be Texas. So, lawsuits filed in the DC Circuit and other judicial circuits inclined to play silly Resistance games are not permitted. The second requirement is that aliens held under the AEA must have the right to contest their deportation: "The notice must be afforded within a rea sonable time and in such a manner as will allow them to actually seek habeas relief in the proper venue before such removal occurs."
