Sec. Homeland Security - Markwayne Mullin — Mullin had a very succinct response to Senate Minority Leader Chuck Schumer's (D-NY) insistence that, "Our ultimate goal is to help the Dreamers, but get a path to citizenship for all 11 million or however many undocumented there are here."

Full Court Press...

We had one court decision of note on Tuesday:

  • ❌ In Urban Sustainability Directors Network v. Department of Agriculture (federal grant terminations) — Judge Beryl Howell (D.C.) GRANTS in part, DENIES in part admin’s motion to dismiss, allowing claims challenging the alleged mass termination of grants to proceed; DENIES the government’s motion to vacate the discovery schedule and plaintiffs’ motion for sanctions.

And the Supreme Court rounds out its first week of oral argument in the 2026 term with:

  • Dept. of Air Force v. Guahan — 
    • 1. Whether the federal government's submission to a state or territorial regulator of an application to renew a RCRA permit is "final agency action" that is immediately reviewable under the Administrative Procedure Act, 5 U.S.C. 704.
    • 2. Whether the federal government must comply with the general environmental review procedures of the National Environmental Policy Act of 1969, 42 U.S.C. 4321 et seq., before submitting a permit-renewal application under RCRA, which sets forth its own specific procedures to review environmental impacts in the context of hazardous-waste treatment.

COMING ATTRACTIONS

President Trump, as noted above, heads to Texas later today, and then Syracuse, New York. On Saturday, he'll be in Tuscaloosa, Alabama, for the Alabama-Georgia game.

Secretary of State Rubio is overseas, traveling to Reykjavík, Iceland, Athens, Greece, and Lisbon, Portugal this week. I expect he'll have a few things to say/share along the way. 

And the Supreme Court will be back next Tuesday and Wednesday to hear oral argument in two more cases.

With today marking the three-year anniversary of the horrific October 7 attack by Hamas on Israel, I wanted to acknowledge the occasion, but to be honest, the words still escape me. So, I'll simply say this: No, I haven't forgotten.
