It still makes no sense to me why the ATF decided to serve the search warrant by conducting an early morning raid on Malinowski's home instead of sending a team to serve the warrant on Malinowski at his workplace, or even stopping him on his way to work. The lack of body cameras by ATF field agents is also troubling.
Luke's story seems to indicate that the violation that might stick is the breaking of the federal records law. I'm not sure why conspiring to just hand over $90 million in forgivable loans to an ineligible organization wouldn't be, but I am no lawyer.
Did you happen to read in the past few days about the indictment of the Southern Poverty Law Center, which is alleged to have paid leaders of racist organizations to be more racist to create a desired narrative and generate more donations?

Did Cole Allen, the shooter and possible Trump assassin, get off some rounds? Was this a friendly fire incident? The truth is, we don’t know yet. What we do know is that while Trump and his staff are praising the Secret Service, Allen should never have been able to get that far inside the Washington Hilton.

- House Ways and Means — Full Committee Hearing with Health System CEOs
- Senate Appropriations, Departments of Labor, Health and Human Services, and Education, and Related Agencies Subcommittee — Hearings to examine proposed budget estimates and justification for fiscal year 2027 for the Department of Education.
- House Education and Workforce, Early Childhood, Elementary, and Secondary Education Subcommittee — "Leveling Down: How Equity Policies Undermine Excellence and Harm Students"

They were, in theory, setting up to vote on the extension of FISA today, but now it's not so certain that's going to happen.

Then, too, King Charles is set to address a joint session of Congress at 3:00 PM Eastern. (Do you suppose King George ever envisioned one of his successors addressing the upstarts in such fashion 250 years down the road?)

This court ruling on Monday caught my eye — for once, a judge not twisting herself in pretzel knots to stymy the administration's agenda.
- ✅ In Doe v. DHS (CBP One App/parole termination), Judge Allison Burroughs DENIES plaintiffs' emergency motion for administrative stay. "The Court’s order vacated procedurally flawed agency action; it did not grant Plaintiffs a substantive entitlement to parole."
Oral argument continues Tuesday at the Supreme Court:
- Cisco Systems Inc. v. Doe I —
- Whether the Alien Tort Statute ("ATS"), 28 U.S.C. § 1350, allows a judicially-implied private right of action for aiding and abetting.
- Whether, if ATS aiding-and-abetting claims are cognizable, mere knowledge rather than purpose suffices to show the requisite mens rea.
- Whether the Torture Victim Protection Act, 28 U.S.C. § 1350 note, allows a judicially implied private right of action for aiding and abetting.
COMING ATTRACTIONS
Oral argument in the Temporary Protected Status (TPS) cases will be held before SCOTUS on Wednesday.
President Trump will deliver remarks at The Villages, Florida, on Friday.
MORNING MUSING
Did you hear the one about the grieving widow? Hoo — that was a real thigh-slapper that one! (If I had sarcasm font, I'd employ it here, in case that's not clear.)
Jimmy Kimmel hasn't been funny in years — if he ever was. (I'm honestly not sure — he never has been my cup of tea.) But that's rather beside the point. His ill-timed crack about First Lady Melania Trump having a "glow like an expectant widow" just two days ahead of yet another assassination attempt on her husband (this one, with her seated right next to him) has been roundly condemned — as well it should be.
But in all of the focus on his disgusting comment in the context of Donald and Melania Trump, there's an even more grievous aspect to what he said that didn't fully dawn on me until a friend and morning show listener — one who recently lost her husband, in fact — observed: "Widows do not glow. 😢"
I'm just going to let that speak for itself.
