MORNING MUSING

On Monday, I reported on the Supreme Court's latest ruling regarding the White House ballroom. It was a 5-4 decision ultimately determining that the group that brought the suit trying to stop the project didn't have standing to do so. As I explained at the time, this was not a final determination by the Court that the East Wing project is lawful (or not). But the practical effect of the ruling is that the project may proceed unless/until such final determination is made.

What was truly striking about the decision is that Chief Justice John Roberts joined with the Court's three liberal justices and penned a dissent that...well, frankly, it left me with the impression that a justice who is usually quite a stickler on standing had gotten all up in his feels regarding Beltway sensibilities. And I don't say that lightly. 

Roberts even invoked crocodiles to make his point, noting that the Court has recognized standing for people whose ability to observe wildlife would be harmed by government action. If “I want to look at a crocodile” can get you through the courthouse door in that context, he reasoned, why not “I want to look at the White House”? It's a memorable line, though perhaps not the devastating analogy Roberts intended: The last I checked, crocodiles weren't federally owned buildings whose appearance the government is responsible for managing. Nor do they play a role in national security — although, come to think of it, maybe they should!
