Michael Roman, one of the 18 co-defendants in the Fulton County District Attorney Fani Willis’s Racketeer Influenced and Corrupt Organizations (RICO) case - which is centered on and includes former President Donald J. Trump - filed an explosive motion today 

In it, he claimed the indictment she secured against him on August 14 was unconstitutional because the lawyer she subcontracted to investigate RICO charges, Nathan Wade, is her lover.

Roman requests the court dismiss his indictment and disqualify Willis from the case. The Atlanta Constitution Journal summarized it this way:

The bombshell public filing alleged that special prosecutor Nathan Wade, a private attorney, paid for lavish vacations he took with Willis using the Fulton County funds his law firm received. County records show that Wade, who has played a prominent role in the election interference case, has been paid nearly $654,000 in legal fees since January 2022. The DA authorizes his compensation.

The motion, filed on behalf of defendant Michael Roman, a former Trump campaign official, seeks to have the charges against Roman dismissed and for Willis, Wade and the entire DA’s office to be disqualified from further prosecution of the case.

Pallavi Bailey, a Willis spokeswoman, said the DA’s office will respond to Roman’s allegations “through appropriate court filings.” Wade did not immediately respond to a request for comment.

Roman, who helped organize alternative electors for the Trump campaign as it responded to election irregularities in the state handling of the 2020 presidential election, filed the motion with the Fulton County Superior Court at 4:42 p.m. 

In the 127-page pleading, Roman also alleged that Wade, whom the AJC reported filed for divorce the day after his November 1, 2021, appointment, was not a legitimate agent of the district attorney, because that appointment was not approved by the Fulton County Board of Supervisors.

Wade had his divorce proceedings sealed on February 10, 2022, however, Roman’s legal team learned that Willis and Wade have taken their relationship on the road, as well as on the waves: 

While the filings in the divorce case are sealed by Court order, undersigned counsel has learned that Willis and Wade have traveled personally together to such places as Napa Valley, California, Florida and the Caribbean and Wade has purchased tickets for both of them to travel on both the Norweigan and Royal Carribean cruise lines. Wade has also purchased hotel rooms for personal trips with funds from the same account used to receive payments under his contract with Willis.

In addition, the district attorney and the special prosecutor have been seen in private together (in a personal relationship capacity) in and about the Atlanta area and believed to have co-habited in some form or fashion at a location that neither of them owned. Sources close to both the special prosecutor and the district attorney have confirmed Willis and Wade had an ongoing, personal and romantic relationship during the pendency of Wade’s divorce proceedings.
