In Yonkers, New York, police arrested Feliciano Perez-Bautista, a Mexican national in the country illegally. The July detainment was due to a charge of gang assault in the first degree.
Eventually, Feliciano’s victim died from his injuries, which added first degree manslaughter.
On July 12th, ICE’s Enforcement and Removal Operations submitted a detainer request to Yonkers PD, as well as to the Westchester Department of Correction on July 30th.
However, both were ignored and Feliciano was released back onto the streets — without anyone notifying ICE.
Immigration Customs Enforcement apprehended Feliciano themselves on November 26th, and he’s being held while deportation to Mexico pends.
New York’s not much for paying attention to federal immigration law — as noted in August by The Daily Caller:
Newly-released information shows that the New York Police Department denied thousands of Immigration and Customs Enforcement detainer requests over a one-year timespan.
The New York Police Department (NYPD) received a total of 2,916 detainer requests from Immigration and Customs Enforcement (ICE) between to July 1, 2018 to June 30 of this year, according to data first obtained by the New York Daily News. Despite the high volume of requests during that time period, every single one was ignored by the NYPD.
As for the case of Feliciano, federal agents aren’t happy.
Field Office Director Thomas Decker had something to say about it, courtesy of ICE.gov:
“When law enforcement agencies decide to not honor ICE detainers and release violent criminals back onto the streets, they are putting their city at serious risk. We want nothing more than to cooperate and work together with local law enforcement authorities in order to protect our communities and keep this nation secure.”
They shouldn’t hold their breath. During the same month of Feliciano’s initial arrest, NY Mayor Bill de Blasio had a message for people illegally in the Big Apple: “This is your city.”
Furthermore, the mayor derided ICE as “a political weapon”:

On Tuesday, Director Thomas slammed politicians for shunning immigration enforcement, accusing them of debilitating cops and allowing criminals to “terrorize” Americans.
“Unfortunately, more and more we are seeing politicians place their own political agenda above the safety of the citizens…which they serve. This leaves local law enforcement agencies handcuffed by these reckless policies which give them no choice but to release criminals, like this unlawfully present Mexican national charged with manslaughter, back onto the streets to further terrorize the community.”
