Donald Trump didn’t hide his disappointment (and annoyance) with the June Supreme Court decision that struck down his executive order limiting birthright citizenship. It’s “too bad for our country,” he wrote on social media at the time.
But he didn’t just take it lying down — the Department of Justice almost immediately sent out a department-wide memo ordering federal prosecutors to prioritize investigations and prosecutions of scammers who try to game the system.
On Thursday, meanwhile, he signed two executive orders to 1) formally classify who is ineligible to take advantage of birthright citizenship, and 2) clamp down on the practice known as “birth tourism,” where fraudsters abuse the visa system and find other ways to magically be in the country when their babies are born, thus granting them automatic U.S. citizenship.
"We're making adjustments because it's very unfair," Trump said at the Oval Office signing ceremony. "They're building businesses around birthright citizenship. That's not the way it was supposed to work. It's a disgrace.”

President Trump is signing two Executive Orders to protect the meaning and value of American citizenship after Trump v. Barbara:
— The first Executive Order non-exhaustively identifies certain categories of children of aliens who are not entitled to birthright citizenship consistent with historical exceptions to birthright citizenship recognized by the Supreme Court in Barbara.
— The second Executive Order delegates presidential authorities to the Secretary of State and Secretary of Homeland Security and directs them to halt the practice of birth tourism.

Miller:
The president is using his authority as commander in chief to sign first an executive order, using the new ruling the Supreme Court issued, to expand the definitions of people who are ineligible for birthright citizenship. That includes, for example, alien enemies of the United States, members of foreign terrorist organizations, and large categories of people who lobby and act on behalf of foreign governments.
Terrorists and alien enemies should have already been ineligible; it’s hard to believe that they weren’t.
Miller went on to explain part two:
The second action that he's taking, which is especially historic, is for the first time ever, in American history, to ban birth tourism…
The idea that people come here, pretending to be a tourist, pretending to be a visitor, saying they want to go to Disneyland…
But the real reason they're here is to have a child, to make that child with an automatic citizen, leave our country, and then have a U.S. citizen child.
So, that practice of birth tourism is, as of the signing of this order, hereby banned.
He added that Trump has made many historic moves on illegal immigration — most notably removing Joe Biden’s welcome mat at the southern border — but he would put this in his top three in terms of importance. “It ends what has been one of the gravest and most egregious abuses of the American system,” he added.
No word yet on whether Judge James Boasberg is already exploring ways to block the EOs.
