Back in mid-November, we reported on a public war of words going on between two members of the North Carolina Supreme Court, which took place against the backdrop of the CBP/ICE sweeps that were going on in cities like Charlotte and Raleigh at the time.
On X, Senior Associate Justice Anita Earls (D) condemned the operation, calling it a "violation of constitutional rights" that had supposedly taken federal agents away from solving crimes like sex trafficking and child abuse (as if those types of criminal illegals were not among the hundreds arrested). She also alleged without evidence that the Trump administration was using "immigrants" as "scapegoats."
"This type of political stunt further erodes the public's trust in the already broken justice system," Earls also wrote, displaying a staggering lack of self-awareness. Conservative Associate Justice Phil Berger, Jr., responded by writing that "What undermines public confidence is not lawful enforcement activity, but the growing trend of judges asserting their personal opinions and positions without facts, without parties before them, and without the neutrality their office demands."

Berger was 100 percent spot on in his assessment, and that should have been the end of that discussion. But Monday, December 1st, was the first day candidates could file for election and reelection in NC, and when Earls was asked about Berger's remarks, here's what she had to say:

Earls has previously faced ethics questions related to partisan statements, and though her saying the quiet part out loud is certainly a gift to the GOP, here she is once again proving she just doesn't get it. Even if it doesn't rise to the level of an ethics violation, certainly it should raise serious questions in the court of public opinion about her ability (or lack thereof) to be impartial.
Then again, Earls has never been shy about wearing her wokeness on her sleeve like a badge of honor. For instance, on the "about" page on her campaign website, she proudly boasts of her past social justice warrioring, including on a committee created by then-Gov. Roy Cooper (D), that many in NC have blamed in part for enabling repeat offenders like Iryna Zarutska's alleged killer, Decarlos Brown, Jr., to continue to violently victimize people:
Justice Earls is the founder of the Southern Coalition for Social Justice, a nonprofit dedicated to advancing racial and social justice through legal advocacy, where she served as Executive Director for a decade.

Justice Earls has also served on the North Carolina State Board of Elections, the North Carolina Equal Access to Justice Commission, and Co-Chaired Governor Cooper’s Task Force on Racial Equity in Criminal Justice.
Incredibly, in the announcement Earls posted to X about her reelection filing, she laughably proclaimed that "Upholding my oath of office to rule without fear or favor has been my guiding light every day on the Court. "

The current breakdown of the NC Supreme Court is 5-2 GOP, and Democrats are desperate to get control back via the 2026 and 2028 election cycles, before the 2030 Census and the inevitable redistricting that will again take place. Defeating Earls in 2026 will be a critical first step to ensuring that sanity will continue to prevail at our state's highest court.
