IN MY ORBIT: Renewed Calls for Court Packing Follow the SCOTUS Leak; 'Keep the Nine' Coalition Welcomes the Conversation

In 2021, when the Democrats were foaming at the mouth to pass a court-packing bill, 15 former State Attorneys General (8 Democrats and 7 Republicans) formed a coalition to protect the independence of the United States Supreme Court. These former AGs drafted a possible Constitutional Amendment, and started working on getting it passed by Congress and then ratified by the states, as is required to amend our Constitution.

Now known as the Keep Nine Coalition, this bipartisan group has garnered the support of over 200 members of CongressOver 170 2022 U.S. House CandidatesOver 20 2022 U.S. Senate Candidatesand a growing list of State Legislative Chambers, Governors, Lieutenant Governors, Attorneys General, a Secretary of State, a Treasurer, and an Auditor.

One of the spokespeople of the Keep Nine Coalition is former Attorney General of Tennessee and Appellate Court Judge Paul Summers. I spoke with AG Summers about the SCOTUS leak, the renewed cries by the Democrats to pack the court, and how this has brought renewed recognition to the Keep Nine Coalition’s mission.

AG Summers had some fascinating insights on the SCOTUS leak, some that I have posited on this platform. My term, “bright, shiny objects” fits here, as well as a full frontal attack on what is left of the Supreme Court’s integrity.

“This is nothing but politics, plain and simple. It impugned the integrity of the Supreme Court.”

According to AG Summers, our country has had nine Supreme Court Justices for 153 years. That’s more than half the life of our Republic. AG Summers and others feel that number should not be changed, and should not be threatened by the vagaries of politics. So, the Keep Nine Coalition are petitioning and educating the American people. A sad fact that AG Summers exposed is that most Americans, including lawyers, think this requirement already exists in the Constitution. It is apparent that civics lessons are desperately needed in our nation, along with deeper education on pure lawmaking in action.

But AG Summers is happy about one thing: At least the talk about Court packing is back at the forefront, and the Keep Nine Coalition can enter the conversation with facts and solutions. AG Summers also talked about what Democrats most fear.

“The Democrats feel like there is going to be a Red Wave from November 8. They are doing all they can right now to change the narrative from rampant inflation, crime all over the nation, the Afghanistan withdrawal, you name it.”

In terms of whether the Justices will be pressured by these tactics, AG Summers said,

“I can tell you now from being an appellate judge, it ain’t going to work.”
